Welcome back.

Candidate positions on the controversial Granite Bridge Pipeline may be a significant factor determining New Hampshire’s next governor. The contested status of other pipelines is also roiling related industries and enlivening local politics wherever they exist.

Two new nominations to the Federal Energy Regulatory Commission (FERC) may finally rebalance its makeup, which has been operating for much of the year with four of its five commissioners – only one of whom is a Democrat.

The recently-launched nonprofit Rewiring America has released its first major report on greening the economy and the jobs that could be created by a full-on effort at electrification. It’s an exciting prospect that requires a post-Trump political ecosystem. We found a related investigative report from DeSmog Blog, exposing efforts by the natural gas industry to delay electrification of the building sector.

Now that we’re heading into the home stretch of this political season, articles we’re finding on climate all project a jittery edginess around the stakes of the November election. Given the urgent need for sharp emissions reductions and a kind of global leadership that’s only possible when America is at its best, Bill McKibben’s suggestion that this election is about the next 10,000 years lacks even a hint of hyperbole.

We caught some encouraging glimpses of steady advances in clean energy and transportation  – things coming our way despite the best efforts of the Trump administration and fossil fuel industry. News from that sector, as usual, amounts to flashing red lights warning of an impending financial implosion.

We wrap up with two stories about “green energy” that is anything but. While Europe continues to insist – contrary to science – that woody biomass is effectively carbon neutral in the short term, American forests are being felled for pellets to fuel their converted coal power plants. This is all based on a carbon accounting error that originated with the Kyoto Climate Agreement, and was grandfathered into the 2015 Paris Climate Agreement. It’s turned out to be a stubbornly difficult problem to correct.

Gas pipeline fuels debate among NH gubernatorial candidates

Democratic gubernatorial candidate Andru Volinsky called the proposed Granite Bridge pipeline a ”$400 million step in the wrong direction” during a press conference in front of the Town Hall Friday.

Volinsky said Liberty Utilities’ proposed 16-inch liquefied natural gas pipeline for the Route 101 corridor between Exeter and Manchester will exacerbate climate change while other high-profile projects, like the Dakota Access pipeline, were being halted around the country.

“A key part of why I’m running for governor is to combat climate change, and part of that effort is to be opposed to fracked gas pipelines projects, like the Granite Bridge pipeline,” said Volinsky, a member of the state Executive Council. “Last municipal election, Exeter went on record as opposed to the pipeline. Fracking is especially dangerous for the environment, ratepayers would have to pay for that project for 20 or 30 years, and to what purpose? To line the pockets of Liberty Utilities and Granite Bridge shareholders.”

The Granite Bridge application is stalled at the state Public Utilities Commission after being filed in December 2017. The project includes a 150- to 170-foot high tank capable of storing 2 billion cubic feet of LNG in an abandoned quarry in West Epping.

Dakota Access Pipeline Saga Stalls Oil Production Recovery In The Bakken

The uncertainty surrounding the future operations of Dakota Access, the key pipeline carrying crude out of the Bakken, is stalling oil companies’ plans to invest in bringing back online the output they had curtailed after the pandemic-driven crash in oil demand and prices, executives told Reuters.

A federal judge ruled on July 6 that the Dakota Access Pipeline, in operation since 2017, must be emptied and shut down by August 5, until a new comprehensive environmental review is completed.

A week later, a U.S. Appeals Court ruled that Dakota Access can continue to operate while the court considers whether the pipeline should be shut down as ordered by a lower court’s ruling.

Until the new saga with the Dakota Access pipeline is resolved, oil drillers in the Bakken are not rushing to restore production as they see the move as too risky in case Dakota Access were to shut down.

Ashland Select Board wins court case against Eversource over gas pipeline

Eversource must remove a decommissioned gas pipeline if it gets the go-ahead to install a new, wider pipeline through Ashland, a state Land Court judge has ruled.

Associate Justice Michael D. Vhay issued the judgment earlier this week, supporting the Town of Ashland’s position.

In Ashland and Hopkinton, Eversource wants to decommission a 6-inch-wide, 3.7-mile underground gas line that passes through both towns and replace it with new 12-inch pipeline. In Ashland, the gas line runs for 2.5 miles, cutting through more 80 house lots, town-owned properties, wetlands, the Chestnut Street Apartments and the conservation-restricted Great Bend Farm Trust.

Town officials and many residents adamantly oppose the project, saying it will have no direct benefit for Ashland residents and runs counter to the town’s sustainability goals.

In a Facebook status posted on the town’s Facebook page,Town Manager Michael Herbert shared the news of the court’s decision.

“Rarely does a small suburban town of 17,000 people take on a corporate giant like Eversource Gas and come out on top,” he said.

NORTH BEND, Ore. — The Oregon Land Use Board of Appeals has reversed a land-use permit approved by the city of North Bend.

The permit is for the proposed Jordan Cove liquefied natural gas export terminal.

The Oregon Shores Conservation Coalition was the petitioner in the appeal. The decision by the North Bend City Council was to approve a temporary dredging material transport pipeline and dredging offloading facility.

Trump makes two FERC nominations, potentially rebalancing commission

President Trump made two nominations to the Federal Energy Regulatory Commission (FERC) Monday, bowing to pressure from Democratic lawmakers who have pushed to maintain the bipartisan split in the commission.

Trump nominated Allison Clements, Democrats’ preferred nominee, alongside Mark C. Christie, who currently serves as chairman of Virginia State Corporation Commission. If confirmed, the two would regulate electricity and natural gas markets alongside other major energy projects.

FERC’s five-member board is supposed to have no more than three members of any one party, but for much of the year it’s been operating with just four members — three Republicans and one Democrat.

Clements currently serves as the founder and president of Goodgrid, LLC, an energy policy and strategy consulting firm. She previously worked for a decade at the Natural Resources Defense Council. She also spent two years as director of the energy markets program at Energy Foundation, which advocates for energy efficiency and renewable energy.

Christie is one of the nation’s longest-serving state utility regulators, having served for 16 years on Virginia’s board overseeing utilities and other industries.

The nominations come as Commissioner Bernard McNamee’s term expired at the end of June.

Mobilizing for a Zero Carbon America envisions a dramatic transformation of the nation’s power, transportation, building, and industrial sectors by 2035 to meet the global heating goals of the 2015 Paris climate agreement. The first project of the newly launched Rewiring America is “based on an extensive industrial and engineering analysis of what such a decarbonization would entail.”

Unplugged: How the Gas Industry Is Fighting Efforts to Electrify Buildings

Just over a year ago, the city of Berkeley, California, passed into law a first-in-the-nation ordinance prohibiting natural gas hookups in new buildings, a move that alarmed the gas industry. This alarm has since boiled over into a full-fledged opposition campaign to counter the rising tide of similar measures meant to restrict gas in favor of constructing all-electric buildings and cutting carbon pollution.

Natural gas constitutes a vast majority, about 80 percent, of the direct fossil fuel CO2 emissions from the residential and commercial sectors, according to the U.S. Environmental Protection Agency (EPA). Transitioning away from direct fossil fuel use in buildings is key for de-carbonizing and meeting climate targets, experts say.

Initiatives are starting to emerge at the local level on the West Coast and in the Northeast to support this transition, with 31 cities in California committed to phasing out gas use in buildings, as of July 8, and several Massachusetts communities in the Boston area doing the same. Policies for electrifying buildings are also in the works in New Jersey as well as Seattle and other cities.

Boston-area lawmakers intend to continue pursuing building electrification ordinances, but they acknowledged their path forward is uncertain after Massachusetts Attorney General Maura Healey struck down the commonwealth’s first building gas ban.

Healey’s decision undermines the effort to ban natural gas in new construction and renovations in Arlington, Cambridge and Newton — all of which modeled their legislation after the rejected bylaw in neighboring Brookline, Mass.

The Board of Building Regulations and Standards — the state agency that Healey argued has exclusive control over building permits — is one potential avenue, [Cambridge City Councilmember Quinton] Zondervan said. The board regularly updates the state building code and could include a stretch code that allows towns and cities to require certain buildings be fossil fuel free. Bay State climate activists are already pushing for a stretch code allowing net-zero building energy requirements.

Brookline and environmental groups have already called for state-level action in light of Healey’s decision, in which the attorney general expressed support for the policy of limiting gas use.

“The attorney general’s opinion makes clear that the state does have the authority to stop this fracked gas infrastructure if it wants,” Massachusetts Sierra Club Chapter Director Deb Pasternak said in a statement. “The fact is that we need an equitable statewide plan here in Massachusetts to close down the fracked gas energy system.”

The Sierra Club, along with ratepayer advocates and other climate activists, have recently presented regulators with plans for building electrification proceedings and gas distribution system phase-outs.

Healey herself has petitioned the DPU to open a proceeding to overhaul gas infrastructure planning in Massachusetts, with a goal of aligning the regulatory framework with state climate goals and transitioning away from fossil fuels.

How the global climate fight could be lost if Trump is re-elected

It was a balmy June day in 2017 when Donald Trump took to the lectern in the White House Rose Garden to announce the US withdrawal from the Paris climate agreement, the only comprehensive global pact to tackle the spiraling crisis.

Todd Stern, who was the US’s chief negotiator when the deal was sealed in Paris in 2015, forced himself to watch the speech.

“I found it sickening, it was mendacious from start to finish,” said Stern. “I was furious … because here we have this really important thing and here’s this joker who doesn’t understand anything he’s talking about. It was a fraud.”

The lifetime of the Paris agreement, signed in a wave of optimism in 2015, has seen the five hottest years ever recorded on Earth, unprecedented wildfires torching towns from California to Australia, record heatwaves baking Europe and India and temperatures briefly bursting beyond 100F (38C) in the Arctic.

These sorts of impacts could be a mere appetizer, scientists warn, given they have been fueled by levels of global heating that are on track to triple, or worse, by the end of the century without drastic remedial action. The faltering global effort to curb greenhouse gas emissions and head off further calamity hinges, in significant part, on whether the US decides to re-enter the fray.

“The choice of Biden or Trump in the White House is huge, not just for the US but for the world generally to deal with climate change,” said Stern. “If Biden wins, November 4 is a blip, like a bad dream is over. If Trump wins, he seals the deal. The US becomes a non-player and the goals of Paris become very, very difficult. Without the US in the long term, they certainly aren’t realistic.”

House climate change bill calls for roadmap
Measure differs from more prescriptive Senate approach

The House unveiled a climate change bill on Wednesday that directs the executive branch of government to create a roadmap for reaching net zero carbon emissions by 2050 and includes sections dealing with solar power subsidies, grid modernization, clean energy jobs, and municipal light plants.

The bill is expected to be taken up in the House on Thursday and then go to a conference committee that will be charged with sorting out differences with a Senate bill that is broader in scope and far more detailed in its instructions.

The House bill requires the administration to achieve net zero emissions by 2050 and sets interim goals for 2030 and 2040. It charges the administration with coming up with a roadmap of policies, regulations, legislative recommendations, and carbon pricing mechanisms to reach the targets.

The Senate bill is far more detailed and prescriptive. It requires the administration to meet statewide emission targets every five years and also requires the setting of emission reduction targets for individual sectors, including transportation, buildings, solid waste, and natural gas distribution. The Senate bill calls for phased-in carbon pricing on automobile and building fuels and requires all MBTA buses to be electrified by 2040.

Mainstream News Prioritises Big Business and Opponents of Climate Action – Study

Statements from large business associations and opponents of climate action are twice as likely to be included in climate change coverage by national newspapers than pro-climate action messaging, according to a new study. The findings suggest mainstream media bias favors entrenched economic interests and that journalistic norms of objectivity and balance have skewed the public conversation around climate change.

“I wanted to specifically look at which interest groups get a say in this debate, what voices are dominating the national conversation about climate change, and how is that reflected in media coverage,” study author Rachel Wetts, Assistant Professor of Environment and Society and Sociology at Brown University, told DeSmog.

The study also found that climate-related messaging from scientific and technical experts was least likely to be picked up in national news. Messaging from business coalitions and large businesses on climate change, on the other hand, received heightened media visibility.

“In terms of this question of whose voices are being heard and who gets to dominate the national conversation around climate change, I find that opponents of climate action and large business interests are the groups that are getting the most visibility, while organizations with scientific expertise are getting very low visibility,” Wetts said in an interview with DeSmog. “This says something about whose voices are being heard that could potentially help explain why we’ve been so slow to adopt any [national] policy to address this issue.”

If one of these budding cells manages to punch through the tropopause, as the boundary between the troposphere and stratosphere is called, the storm mushrooms, feeding on the energy-rich air of the upper atmosphere. As it continues to grow, inhaling up more moisture and breathing it back down as rain and hail, this vast vertical lung can sprout into a self-sustaining system that takes on many different forms.

Colorado’s Eastern Plains is big-time producer of renewable energy, ripe for even more, report says

New report highlights renewable energy’s economic benefits for eastern Colorado: thousands of jobs, millions of dollars a year

Along with wheat, corn and cattle, Colorado’s Eastern Plains grow another big crop: more than 95% of the state’s renewable energy capacity that produces thousands of jobs and millions of dollars in benefits each year.

A report released Tuesday by The Western Way, a conservative organization that promotes environmental stewardship, in partnership with PRO 15 and Action22, policy and economic development organizations, highlights the importance of renewable energy to eastern Colorado.

Greg Brophy, a former state legislator and Colorado director of The Western Way, said he hopes the report demonstrates how valuable renewable energy is to the area’s economy and that it encourages other eastern Colorado counties to “roll out the welcome mat” for wind, solar and battery storage projects.

Sununu Blocks Bill To Expand N.H.’s Required Renewable Energy Use, Now Lowest In New England

Gov. Chris Sununu handed down another expected veto of a clean energy plan Friday.

He rejected a bill that would expand New Hampshire’s Renewable Portfolio Standard and increase how much solar power utilities must use.

Right now, the state caps that solar requirement at 0.7% from this year on out. The bill Sununu vetoed would have increased that to nearly 19% by the year 2040.

Sununu says it represented a handout to the state’s fledgling solar industry. Democrats decried the veto as another effort by the governor to block clean energy expansion.

The bill also would have increased the Renewable Portfolio Standard, to make clean energy cover nearly 57% of New Hampshire’s fuel mix by 2040.

The current standard levels out at around 25 percent in 2025 – the lowest percentage, at the earliest date, of any New England state.

EU industry is seeking ways to save surplus power. Now it’s also hunting for methods to use that stored electricity to make green fuels.

With renewable energy now the cheapest way of mass-producing electricity, the race is on to find the best way to conserve the surplus for use at peak times, and also to use the stored electricity to develop new fuels for transport.

And European Union companies are competing to devise lucrative ways to use this cheap power just as more solar and wind energy is being produced than the market demands.

Large batteries are currently the favoured method, because they are already cost-effective when used with pumped storage. This uses cheap electricity to move water uphill into reservoirs, to be released later to drive turbines when extra electricity is needed to meet peak demand.

Both these technologies take advantage of buying power at rock-bottom prices, and make their profits by storing it – until they can sell it back at much higher prices when the peak arrives.

The newer technologies under development seek to use the cheap surplus electricity to create so-called green hydrogen, and now green ammonia – both for use as substitutes for fossil fuels.

E.P.A. Inspector General to Investigate Trump’s Biggest Climate Rollback
The agency’s watchdog office said Monday it would investigate whether the reversal of Obama-era fuel efficiency standards violated government rules.

The Environmental Protection Agency’s internal watchdog said Monday it had opened an investigation into the agency’s weakening of Obama-era regulations that would have limited automobile emissions by significantly raising fuel economy standards.

The yearlong effort to write the Trump administration rule was plagued with controversy. Just weeks before the final rule was published, the administration’s own internal analyses showed that it would create a higher cost for consumers than leaving the Obama-era standard in place and would contribute to more deaths associated with lung disease by releasing more pollution into the air.

“This is really serious,” said Vickie Patton, general counsel for the Environmental Defense Fund. “It’s rare for E.P.A.’s inspector general to conduct an investigation of the agency’s rule-making.”

Danish electric ferry reports successful first year in service

In its first year of operation on a 22 nautical mile route, the pioneering Danish all-electric ferry Ellen has notched up some noteworthy milestones, according to Danfoss Editron .

Operating between the Danish islands of Ærø and Fynshav, the vessel was designed by Jens Kristensen Consulting Naval Architects and built by the Søby Værft shipyard. Just under 60 meters long and with a breadth of approximately 13 meters, the ferry travels at speeds of 12-12.5 knots, and is capable of carrying 198 passengers in summer months, with this capacity dropping to 147 during winter. It can also carry 31 cars or five trucks on its open deck.

With a 4.3 MWh capacity battery pack, the largest currently installed for maritime use, it is the first electric ferry to have no emergency back-up generator on board.

The E-ferry is the result of a project supported by the EU Horizon 2020 program that set out to achieve two main objectives. The first was to design and build an innovative fully-electric vessel which would incorporate an energy-efficient design, lightweight equipment and materials, and state-of-the-art electric-only systems with an automated high-power charging system. The second objective was to validate the feasibility and cost-effectiveness of the concept to the industry and ferry operators. The fully-electric ferry had to be able to cover distances of up to 22 nautical miles in the Danish part of the Baltic Sea that were, at the time, only operated on by conventional diesel-powered vessels.

As Trump Leaves Permian Oilfield, Industry Insiders Question If 2020 Bust Marks Texas Oil’s Last Big Boom

Yesterday, President Trump left Midland, Texas, after arriving in the state’s Permian oilfield region for a $2,800 a plate luncheon and a “roundtable” that required each participant to pony up $100,000.

The west Texas Mr. Trump left behind bears little resemblance to the region as it was when he first took office in January 2017, as the shale rush resumed following 2016’s oil price plunge.

Today, the shale boom of the 2010’s is officially bust, battered not only by the US’s outsized failure to control COVID-19 outbreaks and an oil price war in which foreign producers proved their ability to steer oil prices, but also a wave of multi-billion dollar write-downs by oil giants — write-downs that predated both the price war and the pandemic and resulted from the industry’s perpetual struggles to generate profits from shale drilling and fracking regardless of the price of oil.

In April, Scott Sheffield, the chief executive of Pioneer Natural Resources, testified before the Texas Railroad Commission (which serves as the state’s oil regulator) that the shale rush had been “an economic disaster.”

“Nobody wants to give us capital because we have all destroyed capital and created economic waste,” Sheffield testified, warning that without state intervention, “we will disappear as an industry, like the coal industry.”

Indeed, before the pandemic struck, the shale industry’s financial foundations were stunningly shaky, with experts questioning the ways companies calculated their reserves, their ability to generate free cash flow from their drilling operations, and ratings agencies grading shale debts at junk levels. The entire fossil fuel industry’s long-term future is also deeply uncertain, as the impacts of climate change become increasingly visceral and the global need to cut emissions from oil and gas more urgent.

Regardless of COVID, the outlook for the oilsands gets dimmer year after year
The pandemic has cost the industry billions, but in the long term, it has bigger challenges

The latest forecast for oilsands production growth was released on Tuesday, and it continues a trend over most of the last decade of industry experts having a less optimistic outlook for the sector.

The new report by IHS Markit expects oilsands production to reach 3.8 million barrels per day of oil in 2030, compared to last year’s projection of production climbing to 3.9 million bpd.

It’s a relatively small change to the forecast the firm released in 2019, but notable because of yet another downward revision. That pattern has occurred just about every year since 2014, when the main oilpatch industry group forecast oilsands output climbing to 4.8 million barrels per day by 2030.

For context, oilsands production at the beginning of this year was about 2.9 million barrels per day.

Analysts with IHS Markit lowered their latest forecast predominantly because of pipelines. There is still doubt about when and if new export pipelines will be built, and that uncertainty will weigh on the confidence level of companies looking to invest the significant funds needed to build new oilsands facilities.

If the fossil fuel industry had acted decades ago, we would not be in a climate emergency. And some believe that this climate emergency is going to cause a financial emergency too.

A new report, published last week by U.S. National Whistleblower Center (NWC), entitled “How fossil fuel industry fraud is setting us up for a financial implosion – and what whistleblowers can do about it,” does not mince its language.

It outlined what it called “widespread deception by fossil fuel executives regarding the financial risks of climate change [which] represents a ticking time bomb that, if not addressed, could contribute to worldwide economic devastation.”

When biomass manufacturer Enviva completes its two newest U.S. Gulf Coast plants on opposite sides of the Alabama-Mississippi state line, likely by 2021, they will be the largest “biomass for energy” manufacturing plants on the planet.

Every year, the two factories will grind the equivalent of a hundred square miles of forest into 2.7 million metric tons of combustible wood pellets, to be burned at former coal plants in Europe and Asia — with all the resulting carbon released into the atmosphere.

These U.S. biomass plants, and the wood pellets they churn out, will thrive atop a shaky Jenga tower of political, economic and environmental paradoxes, according to environmentalists. Unable to compete with carbon fuels like coal or natural gas on price, Enviva’s wood pellet plants will stay afloat because of direct and implicit subsidies coming from the European Union, whose members agreed to derive 32% of their energy from renewables by 2030 — a category that they deemed to include biomass.

Those subsidies, say scientists, are based on now debunked research first conducted and used as guidance for making policy incorporated into the Kyoto Climate Agreement, a policy then grandfathered into the 2015 Paris Agreement. They say the mistake that makes biomass economically viable today is the contention that burning up the world’s forests to produce energy is carbon neutral, an inconvenient untruth that, critics contend, the United Nations has dodged facing at every annual international meeting since Paris.

And so the EU renewables quotas — with their claim of biomass carbon neutrality — have meant a boon for companies like Enviva that sell wood pellets to energy producers and countries now leery of more traditional power sources, ranging from nuclear to coal to hydropower, and who want to squeeze a few more decades out of existing coal burning power plants — now converted to burning wood pellets on an industrial scale.

House Climate Crisis Action Plan Gets a Lot Right on Biomass

Biomass refers to the use of any plant or organic matter to produce energy. Too often, in places that have incentivized biomass use to generate electricity like the European Union, biomass is incentivized to generate electricity in dedicated power plants, or old coal plants converted to run partially or fully on biomass. The fuel demand of these plants is so large that the only source of biomass supply big enough to meet is, unfortunately, wood from forests.

Established science now shows that burning biomass from forests for electricity is not a climate solution within timeframes relevant to addressing climate change. Here in the US, it’s therefore critical that federal climate plans do not repeat the same mistakes as the E.U. in adopting flawed policies based on the debunked assumption of biomass “carbon neutrality.”

In 2018, when the Intergovernmental Panel on Climate Change put out its report describing the climate action necessary to keep global temperatures from rising beyond 1.5 degrees Celsius, it explained that countries would have to cut their CO2 emissions, such as from power plants, to net zero by around 2050. To reach that goal, it said, CO2 emissions would have to start dropping “well before 2030” and be on track to fall by roughly 45% by around 2030. Scientists are clear that what we do over the next decade is incredibly consequential in this fight.

That is why the timeframe used to evaluate the climate impacts of biomass systems is so critical. Evaluate the carbon impacts of biomass-burning over a long enough timeframe, and it may look good. Eventually, if new trees are replanted, they can suck up the carbon that was emitted when older trees were harvested and burned as fuel for energy production. But trees take many decades to grow back. In the meantime, biomass electricity actually loads the atmosphere with more CO2 than fossil fuels (because wood is a less energy dense fuel, so more of it needs to be burned to generate the same amount of electricity).

Weekly News Check-In 7/24/20

Welcome back.

The Ashland Select Board has requested help from Massachusetts Attorney General Maura Healey, as the town presses its opposition to the planned Eversource gas pipeline. Meanwhile, a Louisiana state appeals court ruled that the Bayou Bridge Pipeline Company “trampled” on landowner rights by starting construction without their permission. And we end the section with a recent report from Texas Public Radio on the many legal headwinds facing the Permian Highway Pipeline. This piece brought to you as an admittedly snarky counterpoint to a Kinder Morgan statement you’ll see a little farther down the page, where they claim the project is on schedule.

Greening the economy requires a plan, and Democratic lawmakers in the House Select Committee on Climate Change produced one that deserves serious consideration. We offer a good overview in podcast form, where it’s described as  effective, ambitious, and science-driven, rather than a program designed around politics. Kudos to Committee Chair Kathy Castor (D-FL) for producing a serious roadmap. Other news includes a proposal to buy out and shutter the world’s remaining coal plants – even the new ones.

Climate researches have removed some uncertainty about the extent of Earth warming related to increased atmospheric carbon dioxide. A new report shows more clearly than ever what we risk by continuing with business as usual.

Massachusetts clean energy advocates suffered a setback this week, as Attorney General Maura Healey reluctantly shot down Brookline’s proposed ban on gas connections to new buildings – deferring to the building code as the ultimate authority. This illuminates the need to write gas hookup bans into the next energy efficiency stretch code – something proposed by Mass Climate Action Network’s EZ Code proposal.

Exciting news in energy storage involves long-duration “batteries” based on cooling air to its liquid state. Excess wind or solar power can drive this cooling. When electricity is needed but sun and wind aren’t cooperating, the liquid air can be expanded back to its gaseous state to spin a generating turbine. Manchester, UK will have this system soon – northern Vermont up next!

Massachusetts has completed feasibility studies of flexible community microgrids, and clean transportation is cruising along as fifteen states join California in a push to replace diesel trucks and buses.

The Great American Outdoors Act passed both chambers of Congress with broad bipartisan support and is on its way to the White House for signature. While the intent of the legislation is laudable – fully funding the Land Water Conservation Act which supports National Parks and other public lands – the money comes from the fossil fuel industry. While lawmakers congratulate themselves and news outlets gush about how wonderful it is that this involves no taxpayer money, we have to step back and wonder if there’s any real difference between locking in revenue dependence from the extraction and sale of fossil fuel, and locking in fuel dependence and emissions based on the build-out of pipelines and power plants. We can do better.

The Select Board has sent a letter to Attorney General Maura Healey requesting that she supports the town’s efforts in opposing Eversource Energy’s plan to replace a 3.7-mile gas transfer line that runs through town.

The letter, which was sent late last week and written by board Chair Yolanda Greaves, comes a month after Healey issued a petition calling on the Department of Public Utilities to investigate how its practices and policies affect the state’s clean energy goals.

Court Rules Bayou Bridge Pipeline ‘Trampled’ Rights of Louisiana Landowners

A Louisiana state appeals court has ruled that the Bayou Bridge Pipeline Company illegally “trampled” on the rights of landowners by starting pipeline construction without the landowners’ permission. The pipeline company must pay the landowners $10,000 each plus attorneys fees.

“This is a victory not only for us but for all landowners,” said Theda Larson Wright, one of the three Louisiana landowners who sued Bayou Bridge Pipeline Company (BBP) in September 2018. “All over the country, pipeline companies have destroyed people’s land, often without even attempting to get permission, and dared the landowners to speak up. Well, we did. I hope this victory will encourage many others to as well.”

The Bayou Bridge pipeline is a 163-mile pipeline through southern Louisiana carrying North Dakota crude oil to the Gulf Coast. It is the tail end of a pipeline network including the Dakota Access pipeline and is a joint venture of Energy Transfer and Phillips 66. The Bayou Bridge pipeline traverses ecologically sensitive areas such as the Atchafalaya Basin, the country’s largest river swamp, which contains old growth trees and many endangered species.

‘Wrong Pipeline In The Wrong Place’ — Nationwide Litigation Could Affect Permian Highway Pipeline

The Keystone XL and the Dakota Access pipelines recently suffered major legal defeats — the construction permit for the Keystone XL was revoked in April, and the Dakota Access was ordered to stop pumping oil by early August. Kinder Morgan’s 430-mile Permian Highway Pipeline faces a maze of litigation, and the legal action against other pipelines around the U.S. could have ripple effects in Texas.

In the case of the Dakota Access Pipeline, a judge ruled the multi-billion dollar pipeline, partially owned by Texas-based company Energy Transfers, must complete a more thorough environmental impact study in accordance with the National Environmental Protection Act (NEPA).

Jim Blackburn is an environmental lawyer and a professor at Rice University. He’s also the president of the Trinity Edwards Springs Protection Association (TESPA), which is suing Kinder Morgan for spilling 36,000 gallons of drilling fluid while constructing the Permian Highway Pipeline.

He believes Kinder Morgan — a multibillion dollar company — and the Army Corps of Engineers violated NEPA during the permitting process for the Permian Highway Pipeline.

“NEPA requires full consideration of the impacts of the action you’re undertaking, as well as looking at the alternatives,” Blackburn said.

According to him, if Kinder Morgan and the Corps had considered the environmental impact of the pipeline and possible alternatives, the planned route would be different.

Instead, the U.S. coal industry is benefiting from recovery programs while the world continues to subsidize old, uneconomic coal plants rather than retire them. As we debate a green recovery, now is the time to add an important approach to our tool kit, a cash-for-coal-clunkers program, to help buy the only thing we can’t make more of: time

In the U.S. and Europe, we’ve grown far too accustomed to the coal industry deathwatch. Nearly every day, articles appear announcing new record lows in coal generation, coal retirements and the generalized economic train wreck that is the coal industry. It’s enough to make the average person think the job is done, the transition beyond coal over. Nothing could be further from the truth.

The reality is that for the world to be on track to meet the Paris Agreement goals, every coal unit across the 37 member countries of the Organisation for Economic Cooperation and Development (OECD) must be offline by 2030; the same must happen in Asia and the rest of the world by 2040. The problem is, despite hitting global peak coal several years ago, we are not heading toward a steep decline; instead, we seem to be on a long, flat plateau.

Scientists Revise Predicted Warming Range to Between 2.6 and 4.1 Degrees Celsius

Just how hot the earth will get if carbon dioxide doubles from pre-industrial times is a question scientists have wondered about for the past 40 years.

They have generally agreed that the planet will warm 1.5 to 4.5 degrees Celsius above pre-industrial times. Now, a major new study has narrowed that range, revealing we are already past any hope of a 1.5-degree increase. They have tightened their range to between 2.6 and 4.1 degrees Celsius, or 4.1 to 8.1 degrees Fahrenheit, according to Science Magazine.

The comprehensive international study released Wednesday and published in Reviews of Geophysics relies on three strands of evidence: trends indicated by contemporary warming, the latest understanding of the feedback effects that can slow or accelerate climate change, and lessons from ancient climates, as Science Magazine reported.

Healey reluctantly rejects Brookline bylaw
Measure banned most oil, gas pipes in new buildings

ATTORNEY GENERAL MAURA HEALEY’S office on Tuesday reluctantly shot down a bylaw approved by the town of Brookline that would have barred the installation of most fossil fuel infrastructure in any new buildings or significant rehabs of existing buildings.

In a 12-page ruling, Healey applauded the town’s bid to start addressing greenhouse gas emissions but said the bylaw approved overwhelmingly by town meeting members in November is preempted by the state building code, gas code, and a law giving the Department of Public Utilities oversight of the sale and distribution of natural gas in Massachusetts.

“If we were permitted to base our determination on policy considerations, we would approve the bylaw,” Healey said in her opinion. “Much of the work of this office reflects the Attorney General’s commitment to reducing greenhouse gas emissions and other dangerous pollution from fossil fuels, in the Commonwealth and beyond. The Brookline bylaw is clearly consistent with this policy goal.”

But Healey said she was forced to disapprove the bylaw because it conflicts with existing state laws and codes.

Through its Florida Power & Light utility, NextEra will propose a $65 million pilot in the Sunshine State that will use a 20-megawatt electrolyzer to produce 100 percent green hydrogen from solar power, the company revealed on Friday.

The project, which could be online by 2023 if it receives approval from state regulators, would represent the first step into green hydrogen for NextEra Energy, by far the largest developer and operator of wind, solar and battery plants in North America.

Climate emission killer: construction begins on world’s biggest liquid air battery

Construction is beginning on the world’s largest liquid air battery, which will store renewable electricity and reduce carbon emissions from fossil-fuel power plants.

The project near Manchester, UK, will use spare green energy to compress air into a liquid and store it. When demand is higher, the liquid air is released back into a gas, powering a turbine that puts the green energy back into the grid.

The new liquid air battery, being developed by Highview Power, is due to be operational in 2022 and will be able to power up to 200,000 homes for five hours, and store power for many weeks.

The Highview battery will store 250MWh of energy, almost double the amount stored by the biggest chemical battery, built by Tesla in South Australia. The new project is sited at the Trafford Energy Park, also home to the Carrington gas-powered energy plant and a closed coal power station.

Highview is developing other sites in the UK, continental Europe and the US, including in Vermont, but the Manchester project will be the first.

A state program has helped dozens of Massachusetts organizations explore the potential costs and benefits of pooling energy resources with their neighbors.

The Massachusetts Clean Energy Center awarded grants to study the feasibility of 14 community microgrid projects. Unlike standard microgrids that tend to serve just one property owner, community microgrids incorporate multiple stakeholders and as a result are far more complicated to plan and build.

The goal is to power critical local facilities in a way that improves community resilience in case of disaster and promises substantial reductions in greenhouse gas emissions. Each project received up to $75,000 to investigate the logistics and cost of building a community microgrid. The grantees can also take advantage of technical advice from industry experts.

“Microgrids really provide a sneak preview of our future electric grid,” said Galen Nelson, chief program officer at the Massachusetts Clean Energy Center. “We’re funding feasibility studies to figure out what role they’ll play and how to make them function well.”

15 states will follow California’s push to electrify trucks and buses
A big step forward in reducing harmful emissions from diesel engines

Fifteen states and Washington, DC have announced that they will follow California’s lead in switching all heavy-duty trucks, vans, and buses over to running on electricity, in what could be one of the most significant efforts to reduce harmful diesel engine pollution in the United States. It could also be a big development in the fight for environmental justice because emissions from diesel-powered commercial vehicles disproportionately harm Black, Asian, and Latinx communities.

The states that signed the agreement along with Washington, DC are: California, Connecticut, Colorado, Hawaii, Maine, Maryland, Massachusetts, New Jersey, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, Vermont, and Washington.

California’s Air Resources Board (CARB) announced in late June that all commercial trucks and vans must be zero-emission by 2045, with milestones along the way. The state previously announced a rule in 2018 that says transit agencies must purchase all-electric buses starting in 2029.

The phalanx of states and the District of Columbia are agreeing to similar goals, making it so that “100 percent of all new medium- and heavy-duty vehicle sales be zero emission vehicles by 2050, with an interim target of 30 percent zero-emission vehicle sales in these categories of vehicles by 2030,” according to the New York Governor’s Office.

A shortage of trained mechanics and technicians in the trucking world is nothing new. What’s about to throw a wrench — or battery — into the problem: electric trucks.

“The population of experienced technicians has always been small,” Rick Mihelic, director of future technologies studies at the North American Council for Freight Efficiency, told Transport Dive in an interview. “And now it’s much more complicated because it’s not just hiring a qualified diesel technician. You’re going to have to hire somebody who’s willing to also be an electric technician.”

From training existing mechanics to work on two kinds of engines, to tapping a new generation of technicians attracted to newer, cleaner, software-heavy vehicles, the trucking industry is working to create a workforce ready to fix electric trucks for when they start taking over the road.

Great American Outdoors Act Passes House With Bipartisan Support

On Wednesday, the House passed the Great American Outdoors Act, a sweeping and historic conservation and public lands bill that President Donald Trump has pledged to sign into law, as CNN reported.

As EcoWatch reported, the Senate approved the bill in June in a 73-25 vote. The bill, which is being hailed as one of the most important environmental bills to pass in decades, secures permanent funding for the Land Water Conservation Fund (LWCF). It passed the house in a 310-107 vote and now moves to Trump’s desk.

The Land Water Conservation Fund, which was established in the 1960s, is a little-known bill that produces substantial public benefit. It uses revenue from the oil and gas industry to finance national parks and federal historic sites. A major portion of the fund is also allocated to local and state parks and playgrounds, according to Oregon Public Broadcasting (OPB).

The LWCF has been chronically underfunded, but the Great American Outdoors Act will require mandatory funding of $900 million annually, without using a penny of taxpayer dollars, as CNN reported.
Blog editor’s note: It’s wonderful to fully fund the LWCF and support our national parks, but the funding source is highly problematic. Locking in reliance on the fossil fuel industry to fund popular programs hands its promoters “greenwashing” talking points, while recruiting supporters among park-adjacent communities because of received benefits from a source they might otherwise oppose on environmental grounds.

Kinder Morgan posts financial loss as virus-related demand drop hits pipeline volumes

Kinder Morgan reported a loss in the second quarter versus a year-ago profit as demand destruction due to the coronavirus pandemic significantly reduced throughput on some of its pipelines.

The company expects the sharp declines in crude oil and natural gas production along with reduced demand for refined products to continue in the near term. Feedgas deliveries via its pipelines to liquefaction terminals were down compared with the first quarter amid cancellations of cargoes scheduled to be loaded at the facilities.

Kinder Morgan has cut its expansion capital budget for this year by $660 million, slightly less than the $700 million reduction that it previously estimated. Major projects are continuing and remain on schedule, including Permian Highway Pipeline, the company said.

Fossil Fuel Advocates’ New Tactic: Calling Opposition to Arctic Drilling ‘Racist’
Some say oil and gas exploration is essential as a source of jobs and revenue for Alaska Native communities, but activists argue it is simply exploitation.

When Alaska’s all-white Congressional delegation branded opposition to oil and gas drilling in the Arctic Wildlife National Refuge as a form of discrimination last month, they may have hoped to play into a national dialogue about systemic racism—not necessarily to spark it.

In a letter to the Federal Reserve on June 16, Senators Dan Sullivan and Lisa Murkowsi and Rep. Don Young, all Alaska Republicans, called on federal regulators to investigate whether the refusal of several banks to fund Arctic oil and gas projects discriminated against Alaska Natives, depriving them of social and economic benefits. The politicians had previously called the banks’ refusal a discriminatory tactic “against America’s energy sector.”

But controversy followed quickly. In the weeks following the letter, Native organizers penned op-eds and climate activists posted on social media, blasting the three members of Congress for what they viewed as a hypocritical and misleading narrative.

Oil and gas advocates have for years maintained that opposition to fossil fuel companies equals “green racism,” and have portrayed the industry as providing economic aid to marginalized communities by supporting economic development, sponsoring local programs and promising reliable and affordable electricity.

Some in Indigenous communities also argue in favor of fossil fuel development, given the opportunities it promises. But in Alaska and elsewhere, Indigenous activists concerned about the future of their communities and the planet are opposing drilling and spearheading a movement to end investment in fossil fuels.

Welcome back.

Last week’s news was all about pipeline projects scuttled by fierce popular resistance, smart litigation, and economic reality. This week, proponents of big gas/oil and business-as-usual struck back by further slashing environmental regulations in the hope of greasing the skids for future projects. And with the Dakota Access Pipeline held up indefinitely, a lot more volatile crude may soon be moving by rail on trains and track near you – having never effectively addressed all those “bomb train” safety issues.

Some of the biggest banks financing fossil fuel projects are prime targets of the divestment movement. Many are also backing Rocky Mountain Institute’s new Center for Climate-Aligned Finance. The Center’s mission is to guide banks operating in carbon-heavy sectors, with the goal of achieving global net-zero emissions by 2050. Conflict of interest? Environmental organizations will be watching closely.

The Biden campaign released an ambitious plan that aims to green the economy while rescuing it from the Covid-19 collapse. And while the climate reels from unchecked methane emissions – posting another record – scientists are launching a new satellite system supported by artificial intelligence and machine learning to pinpoint and track global carbon emissions in real time. This will allow direct measurement for the first time – and presents an opportunity for effective management and stronger international agreements.

Some good news in clean energy involves the rescue of rooftop solar net metering from an attempt by the shadowy New England Ratepayers Association (NERA) to move policy decisions from State to Federal jurisdiction. And now that natural gas is no longer seriously considered a clean bridge fuel, we’re facing the tricky question of how best to trim back its role in generating power and heating buildings. Massachusetts, New York, and California are leading the way.

Energy storage and clean transportation are increasingly synergistic. Expect to see robust growth in both sectors, with topped-up EVs providing storage services to the grid, and retired EV batteries finding their way into stationary storage installations – especially now that a new generation of lithium-ion batteries is expected to last much longer than a typical vehicle’s life on the road.

The fossil fuel industry is promoting “renewable” natural gas, derived from non-fossil methane sources. We offer an analysis of this niche fuel, and how it’s being used as cover for the continued use of fossil methane. Also a must-read article from the Times, discussing the huge and growing problem of methane leaks from abandoned oil and gas wells, at a time when fracking companies are failing and leaving cleanup costs to taxpayers.

The wood pellet industry is booming, thanks to policies in both Europe and the U.S. that treat woody biomass as a carbon neutral fuel. A new rule from the Environmental Protection Agency may make the problem worse, and that’s bad news for the climate and forests.

We reported last week that plastics industry lobbyists had pounced on the opportunity presented by uncertainty around modes of disease transmission in the early days of the Covid-19 crisis – convincing states to roll back municipal plastic bag bans in the interest of public safety. Massachusetts Governor Charlie Baker has now reinstated those bans, since we now understand that Covid-19 transmission from surfaces is a low risk. We close with a report on plastics in the environment – everywhere.

Trump moved to speed up the permitting process for major infrastructure projects

President Trump today gutted the National Environmental Policy Act, a move that many environmental advocates worry will make it harder for people to have a say in how major infrastructure projects would affect them. The new rules speed up permitting for large infrastructure projects like pipelines and highways by truncating the environmental review process.

Environmental reviews are designed to figure out if a project will significantly change the environment around the project in some way. The process can take years and involves scientific studies, intense analysis, and time for the public to comment on the proposals. The new rules, first proposed in January, limit the timeline for environmental reviews to two years — even though the process frequently takes twice as long. The changes would also allow projects that aren’t primarily federally funded to bypass the environmental reviews entirely. The revised rules also permit federal agencies to ignore climate change when making their assessments.

NEPA helped Native American tribes and pipeline opponents secure recent victories. A federal judge decided in March that the US Army Corps of Engineers violated NEPA in granting a permit for the Dakota Access Pipeline, and earlier this month ordered the pipeline to shut down pending an environmental review. Pipeline opponents successfully asserted in 2018 that developers of the Keystone XL pipeline violated NEPA.

While today’s changes won’t affect pipeline decisions that have already been made, environmental advocates and attorneys argue that it will become harder for people to contest a major new infrastructure project in the future.

Return of the Bomb Trains

On July 6th Reuters published an article on the potential for a resurgence of moving crude oil from the Bakken region of North Dakota across the country by rail, due to a judge’s decision to shut down the Dakota Access Pipeline over permit issues.

July 6th also was the 7th anniversary of the disaster in Lac-Mégantic, Quebec when a train full of Bakken oil from North Dakota derailed and exploded — resulting in 47 fatalities and the destruction of much of downtown Lac-Mégantic.

And while the timing was just coincidence, it is a stark reminder of the dangers of moving Bakken crude (and Canadian crude) oil by rail and the risks that a resurgence of this industry poses to the 25 million people living along the tracks these oil trains traverse.

After the Lac-Mégantic disaster, regulators in Canada and the U.S. worked to put in place new safety regulations to prevent another such disaster from happening. However, as we have documented here on DeSmog and in my book Bomb Trains: How Industry Greed and Regulatory Failure Put the Public at Risk, the oil and rail industries have effectively blocked or forced the repeal of any meaningful safety regulations.

Regulations for modern electronically controlled pneumatic brakes were repealed by the Trump administration. State regulations to require the volatile Bakken oil to be stabilized to remove the natural gas liquids in the crude oil that make it so dangerous were overruled by the Trump administration.

There still are no regulations about rail track wear and replacement even though track failure is a leading cause of train derailments and is suspected of causing the two most recent oil train derailments that resulted in large spills and fires. There still are no regulations on the length of the trains, even though longer trains derail more often and train operators — the men and women driving the trains — say that longer trains are harder to operate.

And the new tank cars that were supposed to be safer have failed in every major oil and ethanol train derailment they have been involved in to date.

The Rocky Mountain Institute, a clean energy nonprofit, launched the Center for Climate-Aligned Finance on Thursday with financial backing from JPMorgan Chase, Bank of America, Wells Fargo and Goldman Sachs.

With the goal of cutting carbon emissions to net zero by 2050, the center aims to collaborate with banks to design guidance for working with carbon-heavy sectors such as steel or utilities, and to help banks determine which climate benchmarks and data to follow.

Banks are increasingly seeing the value — not just in optics but in revenue — of environmentally responsible investment.

Paul Bodnar, chair of the center and managing director of the institute, said the Poseidon Principles, which encourage financing of more environmentally friendly shipping vehicles, influenced the center’s creation.

“One sector provides the lifeblood that powers all the others, and that is finance,” he told American Banker.

Climate activists indicated the center is an initiative to watch.

“It could drive real steps toward banks aligning with 1.5°C,” Jason Opeña Disterhoft, senior climate and energy campaigner at Rainforest Action Network, said in a statement emailed to Banking Dive, referring to a goal of limiting global temperature increase. “But it could also be used as an excuse for banks to keep supporting the world’s worst climate polluters.

“The four founding partner banks include three of the top four fossil banks in the world, and together are responsible for more than $700 billion in fossil financing since Paris,” he added. “The four of them bank a clear majority of the companies doing the most to expand oil, gas and coal.”

There’s an old truism in the business world: what gets measured gets managed. One of the challenges in managing the greenhouse gas emissions warming the atmosphere is that they aren’t measured very well.

“Currently, most countries do not know where most of their emissions come from,” says Kelly Sims Gallagher, a professor of energy and environmental policy at Tufts University’s Fletcher School. “Even in advanced economies like the United States, emissions are estimated for many sectors.” Without this information “you cannot devise smart and effective policies to mitigate emissions,” she says, and “you cannot track them to see if you are making progress against your goals.”

The lack of good data also complicates international climate negotiations. “It’s frustrating that nearly three decades after countries committed under the United Nations Framework Convention on Climate Change (UNFCCC) to publish national GHG emissions inventories, we still don’t have recent, comprehensive, and consistent inventories for all countries,” says Taryn Fransen of the World Resources Institute.

The ultimate solution to this problem — the killer app, as it were — would be real-time tracking of all global greenhouse gases, verified by objective third parties, and available for free to the public.

When countries began meeting under the UNFCCC in the mid-1990s, that vision was speculative science fiction. It was basically regarded as science fiction when the Paris Agreement was signed in 2015. But science moves quickly — in particular, artificial intelligence, the ability to rapidly integrate multiple data sources, has advanced rapidly in recent years.

Now, a new alliance of climate research groups called the Climate TRACE (Tracking Real-Time Atmospheric Carbon Emissions) Coalition has launched an effort to make the vision a reality, and they’re aiming to have it ready for COP26, the climate meetings in Glasgow, Scotland, in November 2021 (postponed from November 2020). If they pull it off, it could completely change the tenor and direction of international climate talks.

Global emissions of methane, a potent greenhouse gas, soared to a record high in 2017, the most recent year for which worldwide data are available, researchers said Tuesday.

And they warned that the rise — driven by fossil fuel leaks and agriculture — would most certainly continue despite the economic slowdown from the coronavirus crisis, which is bad news for efforts to limit global warming and its grave effects.

The latest findings, published on Tuesday in two scientific journals, underscore how methane presents a growing threat, even as the world finds some success in reining in carbon dioxide emissions, the most abundant greenhouse gas and the main cause of global warning.

“There’s a hint that we might be able to reach peak carbon dioxide emissions very soon. But we don’t appear to be even close to peak methane,” said Rob Jackson, an earth scientist at Stanford University who heads the Global Carbon Project, which conducted the research. “It isn’t going down in agriculture, it isn’t going down with fossil fuel use.”

Reducing that metric, known as the “social cost of carbon,” has helped the administration massage cost-benefit analyses, particularly for rules that allow power plants and automobiles to emit more planet-warming carbon dioxide.

Columbia University is taking new steps to make climate change, which has been studied there for decades, an even more prominent part of the school’s mission. And Maureen Raymo is a big part of that.

On July 1, Dr. Raymo, one of the world’s leading oceanographers and climate scientists, became interim director of the Lamont-Doherty Earth Observatory. Founded in 1949 and perched on hills overlooking the Hudson River 18 miles north of Manhattan, the observatory has been one of the world’s leading centers of scientific exploration into earth sciences and climate change. It was a Lamont researcher, Wallace Broecker, who brought the term “global warming” to public attention in a landmark 1975 paper.

And while there are more women represented at Lamont today than when Dr. Raymo was a graduate student there in the 1980s, she comes to her leadership position at a time when addressing other issues of diversity and equity in the field, and within the institution, is overdue.

Having experienced discrimination in her own career, she said an important way to address it is to “get into a position where you can change things.” She has dedicated fans among Lamont students, who value not just her scientific prowess but also her attention to social justice issues.

FERC shuts down petition to upend net metering, McNamee signals issue could return

The New England Ratepayers Association’s (NERA) petition was opposed by a wide swath of industry leaders, environmentalists, bipartisan government officials, legal experts and others. In total, almost 50,000 groups and individuals issued comments in opposition, while just 21 supported it.

“NERA’s petition to attack rooftop solar investments and gut energy savings during a health and financial crisis was ill-conceived,” Adam Browning, executive director of Vote Solar, said in a statement. Vote Solar and Solar United Neighbors drove over 20,000 comments in opposition to the petition by the filing deadline.

FERC dismissed the NERA petition on the grounds that the group was unable to point to a particular harm.

Instead, NERA “asked the commission to make certain jurisdictional determinations regarding energy sales from rooftop solar facilities, and other distributed generation located on the customer side of the retail meter,” said Chatterjee. “Declaratory orders to terminate a controversy, or remove uncertainty, are discretionary. We exercise that discretion today and find that the issues presented in the petition do not warrant a generic statement from the commission at this time.”

But NERA saw the commission’s order and the two commissioner’s concurrence statements as a sign the issue could be raised again.

“While we are disappointed by FERC’s decision to dismiss our [p]etition on procedural grounds this issue is far from resolved,” Marc Brown, president of NERA, said in a statement. “FERC demonstrably leaves the door open for NERA to address the concerns raised by the Commissioners in its order.”

States are confronting the future of gas in buildings — and facing a set of high-stakes questions.

In early June, the attorney general of Massachusetts, Maura Healey, filed a petition with state utility regulators advising them to investigate the future of natural gas in the Commonwealth. Healey described the urgent need to figure out how the gas industry, which helps heat millions of homes throughout freezing Northeastern winters, fits into the state’s plan to zero-out its greenhouse gas emissions by 2050 — especially considering the fuels burned for indoor heating and hot water are responsible for about a third of the state’s carbon footprint.

Eliminating emissions from this sector means venturing into uncharted waters. While many states are rapidly developing wind and solar farms to cut carbon from their electric grids, few are tackling the thornier challenge of reducing the gas burned in buildings. Officials in California and New York, which both have binding economy-wide net-zero emissions laws, have recently come to the same conclusion as Healey: Meeting state climate goals is going to require changes to the way gas utilities are regulated. Earlier this year, both states opened up precisely the kind of investigation that Healey is requesting in Massachusetts.

Natural gas, a fossil fuel, has long been called a “bridge” to a cleaner energy future because burning it has a much lower carbon footprint than burning coal or oil. But research has called that narrative into question by showing that methane leaking across the natural gas supply chain raises its climate impact significantly. Recent developments have called the economics of natural gas into question, too: In early July, the developers of the high-profile Atlantic Coast Pipeline decided to abandon the project after an onslaught of lawsuits made the pipeline too expensive to build.

California, Massachusetts, and New York haven’t decided whether — or to what extent — natural gas can remain in their energy mixes. But the point of these investigations is much larger than those questions. There’s no established roadmap for managing the transition to zero-emissions buildings, and there are serious consequences to getting it wrong — huge cost burdens on residents, mass layoffs and bankruptcies at utilities, and of course, climate disaster.

As the end of Massachusetts’ state legislative session draws near, activists, municipal officials, businesses, and civic organizations are urging lawmakers to take action on a bill that would require a 100% renewable electricity transition by 2045 — and making plans for next steps if the measure is not passed this year.

“We want to make sure that this year does not go by without strong and decisive action on clean energy at the Statehouse,” said Ben Hellerstein, state director for Environment Massachusetts.

Massachusetts Gov. Charlie Baker in January committed to a goal of net-zero greenhouse gas emissions by 2050. Many, however, argue that this target will be impossible to hit without stronger measures to accelerate the switch to renewable energy. If current standards are not changed, the transition to clean energy would not be complete until the turn of the next century.

To address this disparity, state Rep. Marjorie Decker and state Rep. Sean Garballey sponsored a bill (H.2836) that calls for all the state’s electricity to be renewably sourced by 2035, and all energy used for transportation and heating to be renewable by 2045.

California Awards $10.8M to Reuse EV Batteries in Solar & Microgrid Projects

The California Energy Commission (CEC) awarded $10.8 million to four projects that will explore repurposing used batteries from electric vehicles (EV), partly to support microgrids.

The awards approved in meetings in June and July stemmed from a solicitation for research and development projects showing how used batteries could cost-effectively integrate solar at small-to-medium commercial buildings.

With a goal of having 5 million zero-emission vehicles on the road by 2030, the commission is looking for ways to give degraded car batteries a second life. Typically, EV batteries are retired when they lose 70 percent to 80 percent of their capacity. However, they can be used for other applications like energy storage.

‘Enormous Step’ for Energy Storage as Court Upholds FERC Order 841, Opening Wholesale Markets
Federal regulators — not utilities and states — get to decide how batteries engage in transmission-scale power markets, the appeals court rules.

In a victory for the energy storage industry, a federal appeals court has upheld the Federal Energy Regulatory Commission’s Order 841, clearing the way for transmission grid operators across the country to open their markets to energy storage, including aggregated batteries connected at the distribution grid or behind customers’ meters.

Friday’s court opinion (PDF) declared that FERC has jurisdiction over how energy storage interacts with the interstate transmission markets it regulates, even if those systems are interconnected to the grid under regulations set by the states.

The court also rejected arguments by utility groups and state utility regulators seeking to opt out of allowing energy storage resources (ESRs) to participate under Order 841, which allows for units as small as 100 kilowatts to access wholesale markets.

Instead, the three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit agreed with FERC’s contention that “[k]eeping the gates open to all types of ESRs — regardless of their interconnection points in the electric energy systems — ensures that technological advances in energy storage are fully realized in the marketplace, and efficient energy storage leads to greater competition, thereby reducing wholesale rates.”

Next Up for Electrification: Heavy-Duty Trucks and Construction Machinery
Electrified transport is not just about cars anymore, as California’s landmark Advanced Clean Trucks regulation shows.

Electric models of work trucks, commercial vehicles, and construction machinery are hitting the market in greater numbers than ever before, and policymakers are growing increasingly optimistic about the sector. The California Air Resources Board (CARB), the state’s powerful air quality regulator, voted last month to require that every new truck sold in the state by 2045 be zero-emission, with truck makers forced to begin the transition in 2024.

Part of the challenge in electrifying transportation is simply getting enough good models on the market to attract customers and foster competition. In that realm, things are advancing: By 2023, there will be 19 all-electric or hydrogen fuel cell versions of heavy-duty trucks in production in North America, up from five Class 8 models available today, according to the Rocky Mountain Institute.

In Europe, meanwhile, there are early signs of progress on electrifying off-road construction equipment, with electric versions of excavators, loads and dumpers now available from a range of manufacturers including Hitachi, Komatsu and Volvo. Oslo launched the world’s first zero-emission construction site last year, and Norway’s capital city has mandated that by 2025 all public construction sites will operate only zero-emission construction machinery.

Report: Push for Renewable Natural Gas Is More Gas Industry ‘Greenwashing’

“Renewable natural gas,” or RNG, is an alternative gas fuel that comes from landfills, manure, or synthetic processes. That’s opposed to the fossil gas that drillers traditionally pump out of underground reserves in oil and gas fields.

With “renewable” in the name, it may sound like a promising alternative to the fossil-based “natural” gas commonly used for heating and cooking in buildings. According to a new report from Earthjustice and Sierra Club, however, these fuels pitched as “renewable ” and environmentally friendly alternatives to fossil gas amount to a PR campaign meant to distract from efforts to convert the building sector to all electric power.

The report, published July 14, argues that RNG is an example of fossil fuel industry greenwashing and is not a viable solution for simply replacing fossil gas in buildings. According to the report, RNG is touted by gas utilities for the purpose of countering building electrification policies that restrict the use of gas in buildings for uses like heating, hot water, and cooking. Converting buildings to all-electric usage is recognized as a key climate strategy to shift away from fossil fuels, because electricity can be generated from a variety of sources that do not produce globe-warming emissions.

Oil and gas companies in the United States are hurtling toward bankruptcy at a pace not seen in years, driven under by a global price war and a pandemic that has slashed demand. And in the wake of this economic carnage is a potential environmental disaster — unprofitable wells that will be abandoned or left untended, even as they continue leaking planet-warming pollutants, and a costly bill for taxpayers to clean it all up.

Still, as these businesses collapse, millions of dollars have flowed to executive compensation.

The industry’s decline may be just beginning. Almost 250 oil and gas companies could file for bankruptcy protection by the end of next year, more than the previous five years combined, according to Rystad Energy, an analytics company. Rystad analysts now expect oil demand will begin falling permanently by decade’s end as renewable energy costs decline, energy efficiency improves, and efforts to fight climate change diminish an industry that has spent the past decade drilling thousands of wells, transforming the United States into the biggest oil producer in the world.

The environmental consequences of the industry’s collapse would be severe.

On this side of the Atlantic, new pellet plants are being proposed in South Carolina, Arkansas and other southern states. And Southern coastal shipping ports are expanding along with the pellet industry, vying to increase deliveries to Asia.

While the United States has fallen into a coronavirus-induced recession that dealt a blow to oil, gas, and petrochemical companies, for biomass production across the South, it’s still boom time.

The industry has exploded, driven largely by European climate policies and subsidies that reward burning wood, even as an increasing number of scientists call out what they see as a dangerous carbon accounting loophole that threatens the 2050 goals of the Paris climate agreement.

This month, the Environmental Protection Agency, acting at the direction of the U.S. Congress, is expected to propose securing that loophole with a new rule that details how burning biomass from forests can be considered carbon neutral, at least in the United States.

The industry wants to see regulations that will keep their businesses growing, including expanding U.S. energy markets that now barely exist. But some scientists and environmental groups argue that new EPA rules that are favorable to the industry would put the climate at further risk, along with forest ecosystems across biologically rich landscapes.

Shoppers once again can bring their own reusable bags to grocery stores and pharmacies and no longer will have the option to use single-use plastic bags in places with municipal bans on them.

Environmental groups are thrilled. They have been wary of what they say is an opportunistic plastics industry that, early on, used the coronavirus pandemic to stoke fear about the safety of reusable bags in an attempt to kill plastic bag bans.

Gov. Charlie Baker on Friday rescinded his March 10 emergency order that temporarily lifted the ban on plastic bags supplied in stores to protect the public and essential workers from infection with the coronavirus, back when there was less certainty about the risk of catching the virus from touching surfaces.

‘Our life is plasticized’: New research shows microplastics in our food, water, air

In 1997, Charles Moore was sailing a catamaran from Hawaii to California when he and his crew got stuck in windless waters in the North Pacific Ocean. As they motored along, searching for a breeze to fill their sails, Moore noticed that the ocean was speckled with “odd bits and flakes,” as he describes it in his book, Plastic Ocean. It was plastic: drinking bottles, fishing nets, and countless pieces of broken-down objects.

“It wasn’t an eureka moment … I didn’t come across a mountain of trash,” Moore told Mongabay. “But there was this feeling of unease that this material had got [as] far from human civilization as it possibly could.”

Moore, credited as the person who discovered what’s now known as the Great Pacific Garbage Patch, returned to the same spot two years later on a citizen science mission. When he and his crew collected water samples, they found that, along with larger “macroplastics,” the seawater was swirling with tiny plastic particles: microplastics, which are defined as anything smaller than 5 millimeters but bigger than 1 micron, which is 1/1000th of a millimeter. Microplastics can form when larger pieces of plastics break down into small particles, or when tiny, microscopic fibers detach from polyester clothing or synthetic fishing gear. Other microplastics are deliberately manufactured, such as the tiny plastic beads in exfoliating cleaners.

“That’s when we really had the eureka moment,” Moore said. “When we pulled in that first trawl, which was outside of what we thought was going to be the center [of the gyre], and found it was full of plastic. Then we realized, ‘Wow, this is a serious situation.’”

Plastic waste isn’t just leaking into the ocean; it’s also polluting freshwater systems and even raining or snowing down from the sky after getting absorbed into the atmosphere, according to another study led by Steve and Deonie Allen. With microplastics being so ubiquitous, it should come as no surprise that they are also present in the food and water we drink.

Weekly News Check-In 7/10/20

Welcome back.

This week it’s possible to look toward the horizon, squint a little into just the right kind of light, and glimpse the faint contours of a sustainable future. The big news stories include the cancellation of the $8 billion, 600 mile Atlantic Coast Pipeline; a federal district court order to shut down and drain the Dakota Access Pipeline pending a proper environmental review; and a decision by the U.S. Supreme Court refusing to allow continued construction of the Keystone XL Pipeline pending appeal of its water crossing permit – effectively halting a project that presidential candidate Joe Biden promised to end if elected. After years of activism and litigation, the environmental community is celebrating significant progress in the fight against fossil fuel infrastructure buildout. Almost every article in this week’s News Check-In relates to this potential turning point.

Although the Trump administration continues to use the COVID-19 pandemic as cover for its rollback of climate regulations, lawsuits against governments and fossil fuel companies are proliferating worldwide. The sophistication and success of this litigation has the fossil fuel industry on the ropes, with some analysts concluding it’s no longer possible to build a major pipeline project in the United States. A recent circuit court ruling that the Federal Energy Regulatory Commission (FERC) does not have the authority to postpone decisions on stakeholder requests for rehearing indefinitely, reduces industry advantage even more. As utilities survey this landscape and consider infrastructure investments, they increasingly conclude that renewables are a safer bet than new pipelines and power plants.

It’s worth remembering that significant portions of the natural gas pipeline construction frenzy has been to connect fracking wells to the once-promising liquefied natural gas (LNG) export market. The controversial and highly contested Weymouth compressor station project exists for the primary purpose of pushing fracked gas from the Marcellus shale play up to Nova Scotia’s planned Goldboro LNG terminal. But the global pandemic cratered LNG prices, and the future promises lower demand and much thinner margins than previously imagined. LNG projects are being cancelled or placed on hold worldwide – and the future of Goldboro is uncertain.

So this is a good time to focus on some of the goals and challenges facing a rapid transition to clean energy. One place to start is the Climate Plan just published by the Biden-Sanders “unity task force”. It describes a vision for economic recovery that addresses both climate change and longstanding social and environmental equity issues. Electric vehicles are part of all this, and the auto industry has lately been buzzing about new “million mile” batteries. We found an article explaining that in practical terms.

After all this encouraging news, we’ll close with a cautionary tale: while the pandemic and economic downturn hurt fossil fuels, it’s been something of a gift to the related plastics industry. Lobbyists successfully pushed aside recently-imposed plastic bag bans by promoting mostly unsupported theories of the relative health safety of single-use packaging. It may take years to recover lost ground in public acceptance of reusable bags.

Duke Energy, Dominion abandon the $8 billion Atlantic Coast Pipeline

The $8 billion, 600-mile Atlantic Coast Pipeline is dead.

Dominion Energy Inc. and Duke Energy Corp. are canceling the project because of continuing court delays likely to drive the price tag higher. That would threaten the economic viability of the project, they say.

Bound up in the cancellation is Dominion’s decision, announced separately, to sell it gas transmission business to Berkshire Hathaway Energy for $4 billion in cash and the assumption of $5.7 billion in debt.

Duke and Dominion specifically cite the April decision by a federal judge in Montana that vacated a key water permit for the controversial Keystone XL pipeline issued by the U.S. Army Corps of Engineers.

Known as a Nationwide Permit 12, the permission to cross water bodies and wetlands was issued under an expedited process also used to permit the ACP. A decision by the 9th Circuit Court of Appeals at the end of May allowing the order to stand until it is heard on the merits threatened to delay the Duke and Dominion project for at least a year.

Sunday’s announcement of the cancellation of the Atlantic Coast Pipeline (ACP) was remarkable for so many reasons. Not least that the two companies, Dominion and Duke, are the most powerful corporate entities in their respective states (Virginia and North Carolina). For these two corporate giants to back down is a rare and beautiful thing to behold.

This victory comes as an enormous relief to people all along the more than 600 miles of pipeline route through West Virginia, Virginia, and North Carolina. Farmers, homeowners, small business entrepreneurs — the pipeline fighters who won this rich victory were everyday people whose lives were upended for the past six years just because Dominion and Duke came up with a nifty scheme to enrich their shareholders with guaranteed ratepayer money. Or so they’d hoped.

There is little doubt that movements for environmental and climate justice in the U.S. and Canada are turning the tide on a reckless and arrogant industry that has run roughshod over all else for too long. But public statements from the companies involved, as well as from U.S. Secretary of Energy Dan Brouilette, mislead the public about the demise of ACP, as well as the implications for U.S. energy supply.

Judge suspends Dakota Access pipeline over environmental concerns

A federal judge has sided with the Standing Rock Sioux tribe and ordered the Dakota Access pipeline shut down until a more extensive environmental review is done.

US district judge James Boasberg said previously the pipeline, which has been in operation three years, remains “highly controversial” under federal environmental law, and a more extensive review was necessary than the environmental assessment that was done by the US Army Corps of Engineers.

In a 24-page order Monday, Boasberg wrote that he was “mindful of the disruption such a shutdown will cause”, but said he had concluded that the pipeline must be shut down.

“Clear precedent favoring vacatur during such a remand coupled with the seriousness of the Corps’ deficiencies outweighs the negative effects of halting the oil flow for the 13 months that the Corps believes the creation of an EIS will take,” Boasberg wrote.

Energy Transfer Launches Appeals Following Court Order to Shut Down Dakota Access Pipeline

On Monday, July 6, a federal judge ordered the shutdown of the Dakota Access pipeline (DAPL) by August 5. The move follows a March judgment that ordered the pipeline to undergo a more thorough environmental review.

However, Energy Transfer, the pipeline’s parent company, later revealed that the company was continuing to offer deals to oil companies to ship their product on DAPL during times when the pipeline is slated to be shut down. Today, the legal battle moved towards the U.S. Court of Appeals for the District of Columbia Circuit, after the judge denied a request to freeze the shutdown order.

Energy Transfer said that it was continuing to offer shippers oil transportation on DAPL after the court-ordered shutdown date, Bloomberg reported on July 8, adding that the company had made “no moves to take it offline.”

“We are not shutting in the line,” Energy Transfer spokeswoman Vicki Granado told Bloomberg, adding “we believe [Judge James Boasberg] exceeded his authority and does not have the jurisdiction to shut down the pipeline or stop the flow of crude oil.”

Energy Transfer’s statement that DAPL was not being shut down caused a stir, with some observers asking whether the company intended to openly defy the federal court.

“To be clear, we have never suggested that we would defy a court order,” the company wrote. “Rather, DAPL is seeking appropriate relief from that order through the established legal process.”

The suggestion that the company might keep oil flowing unlawfully garnered immediate condemnation from Indigenous and environmental organizations.

“Perhaps they’re taking their inspiration from the father of the Trail of Tears, Andrew Jackson. In response to the 1832 Supreme Court decision that established tribal sovereignty in the U.S. — Worcester vs. Georgia — President Jackson declared: ‘[Chief Justice] John Marshall has made his decision. Now let him enforce it,’” the Lakota People’s Law Project, a Bismark-based legal advocacy group, wrote in a statement.

The Supreme Court on Monday rejected a request from the Trump administration to allow construction of parts of the Keystone XL oil pipeline that had been blocked by a federal judge in Montana. But the court temporarily revived a permit program that would let other oil and gas pipelines cross waterways after only modest scrutiny from regulators.

The court’s brief, unsigned order gave no reasons, which is typical when the justices rule on emergency applications, and it said it would last while appeals moved forward. There were no noted dissents.

Environmental groups had challenged the permit program, called for by the Clean Water Act, saying it posed a threat to endangered species. In April, Judge Brian M. Morris of the Federal District Court in Montana suspended the program, which is administered by the Army Corps of Engineers, saying that it had been improperly reauthorized in 2017.

From the Pandemic to the Protests, Trump Is Using National Crises as Cover for Climate Rollbacks

If there’s one thing we’ve learned since we began, three months ago, to track the Trump administration’s climate rollbacks and favors to fossil fuel under cover of the COVID-19 pandemic, it’s that the fossil fuel industry and its allies never waste a good opportunity to advance their interests with as little public scrutiny as possible.

So in the days and weeks since the first protesters hit the Minneapolis streets on May 26 over the killing of George Floyd, we have not been surprised to see Trump’s team use the national uprising for Black lives and against police brutality for cover to advance a new flurry of incentives for fossil fuel development.

But what is remarkable is how sweeping these moves have been. Over just the first two weeks of June, the Trump administration knocked the foundations out from under U.S. environmental protections by targeting three key laws that the fossil fuel sector has long fought to weaken: the Clean Air, Clean Water, and National Environmental Policy acts.

Report: Global Climate Lawsuits Against Governments and Polluters on the Rise

Climate litigation is not going away any time soon.

Lawsuits demanding accountability and action on the existential threat of climate change continue to take hold across the world with some significant new developments and new cases emerging over the past year, according to a new report on trends in global climate change litigation.

That report, published July 3 by the London School of Economics’ Grantham Research Institute on Climate Change and the Environment, provides an overview of climate change lawsuits around the world including key developments between May 2019 and May 2020. Grantham Research Institute maintains a database of global climate change lawsuits and in recent years has issued annual reports on trends in climate litigation.

While a majority of climate-related lawsuits are routine cases such as regulatory proceedings or challenges to fossil fuel permitting, cases are also being brought more strategically as a way to hold governments and companies accountable for damaging climate impacts. This kind of litigation against national governments and against fossil fuel companies has taken off in recent years.

There’s no quick fix for climate change
Scientists looked for a ‘shortcut’ and didn’t find one

It could take decades before cuts to greenhouse gases actually affect global temperatures, according to a new study. 2035 is probably the earliest that scientists could see a statistically significant change in temperature — and that’s only if humans take dramatic action to combat climate change.

Specifically, 2035 is the year we might expect to see results if we switch from business-as-usual pollution to an ambitious path that limits global warming to under 2 degrees Celsius — the target laid out in the Paris climate agreement. The world isn’t on track to meet that goal, so we might not see the fruits of our labor until even later. That means policymakers need to be ready for the long haul, and we’re all going to need to be patient while we wait for the changes we make now to take effect.

“I foresee this kind of train wreck coming where we make all this effort, and we have nothing to show for it,” says lead author of the study, Bjørn Samset. “This will take time.”

The Atlantic Coast Pipeline is officially dead as of Sunday, and the Supreme Court delivered another blow to the troubled Keystone XL Pipeline on Monday. While the Atlantic Coast Pipeline’s demise was a decision made by its developers, and Keystone’s impairment a judicial matter, both outcomes are directly tied to the same ongoing battle over a federal permit that helps developers to fast-track pipeline construction called Nationwide Permit 12 (NWP 12). Its fate could have far-reaching consequences for pipeline development all over the country.

NWP 12 is a streamlined permitting process that’s been around since the 1970s and is designed to get infrastructure built faster. It is considered a “general” permit, in that it gives blanket permission for certain standard construction activities that have been deemed to have minimal impact to rivers, streams, and wetlands. Under the Clean Water Act, pipelines must obtain a permit from the U.S. Army Corps of Engineers in order to cross U.S. waters. Pipeline developers can either apply for a Clean Water Act permit for their specific project, which requires extensive environmental assessment and a public comment period, or, they can seek permission to use NWP 12. NWP 12 allows them to skip that public, comprehensive review process if they can demonstrate to the Corps that the project will result in only “minimal adverse environmental effects.”

Environmental groups have been arguing for years that NWP 12 was never meant to be used to streamline such large and environmentally risky infrastructure projects and that pipelines like Keystone should have to undergo full and transparent environmental assessments.

“We need to go back to this individual permit process where there’s a real analysis, there’s public input, there’s everything that the law requires of these types of projects to make sure that they’re not harming the environment or endangered species or anything else,” said [Jared Margolis, a senior attorney for the Center for Biological Diversity].

They are among the nation’s most significant infrastructure projects: More than 9,000 miles of oil and gas pipelines in the United States are currently being built or expanded, and another 12,500 miles have been approved or announced — together, almost enough to circle the Earth.

Now, however, pipeline projects like these are being challenged as never before as protests spread, economics shift, environmentalists mount increasingly sophisticated legal attacks and more states seek to reduce their use of fossil fuels to address climate change.

“You cannot build anything big in energy infrastructure in the United States outside of specific areas like Texas and Louisiana, and you’re not even safe in those jurisdictions,” said Brandon Barnes, a senior litigation analyst with Bloomberg Intelligence.

The growing opposition represents a break from the past decade, when energy companies laid down tens of thousands of miles of new pipelines to transport oil and gas from newly accessible shale formations in North Dakota, Texas and the Appalachian region.

Strong grass roots coalitions, including many Indigenous groups, that understand both the legal landscape and the intricacies of the pipeline projects have led the pushback. And the Trump administration has moved some of the projects forward on shaky legal ground, making challenging them slightly easier, said Jared M. Margolis, a staff attorney for the Center for Biological Diversity.

In the meantime, the entire energy industry is wrestling with the economic fallout from the coronavirus pandemic, which has caused demand for oil and gas to drop worldwide. Falling energy prices further complicate the financial case for new pipelines.

A recent ruling from the D.C. Circuit Court of Appeals that prevents federal regulators from delaying decisions on whether to build out gas infrastructure indefinitely leaves many unanswered questions for the power sector, attorneys say.

Last week, the court ruled 10-1 that the Federal Energy Regulatory Commission does not have the authority to postpone decisions on requests for rehearing indefinitely. The Allegheny Defense Project v. FERC en banc hearing concerned the commission’s practice of delaying landowners’ requests for rehearing on pipeline development, while developers could move forward with construction under the Natural Gas Act.

But the D.C. Circuit’s response was much broader than anticipated, according to industry lawyers, and as a result could lead to a dramatic shift in legal processes before FERC.

The Atlantic Coast Pipeline’s cancellation marks the natural-gas market’s “third high-profile victim in the last six months,” [director of the North American gas team at Wood Mackenzie, Dulles Wang] wrote in a Monday note. The others include Williams Co.’s Northeast Supply Enhancement and Constitution Pipeline projects, which were withdrawn after facing permitting denials and public opposition from New York state.

“The setbacks speak to the difficulties of building new pipeline projects in the northeast U.S., even when there is actual consumer demand that supports these projects,” Wang said.

The legal victories for environmental groups on technical permitting issues are part of a broader fight against the global warming impacts of expanding fossil fuel infrastructure. The Federal Energy Regulatory Commission has so far denied challenges based on the greenhouse gas impacts of pipeline projects, but groups including The Sierra Club and the Environmental Defense Fund continue attacking those decisions in court.

For utilities and energy companies, the mounting challenges to pipeline projects may serve as an incentive to shift from plans to rely on natural gas as a bridge fuel, and toward a less risky role building ratepayer-financed electric infrastructure to serve an increasingly renewable-powered grid, analysts say.

US LNG Exports at 20-month Low

Natural gas flows to U.S. liquefied natural gas (LNG) export plants plunged this month after falling to a 20-month low in June as coronavirus lockdowns cut global demand for the fuel.

Before the pandemic slashed energy demand, U.S. producers counted on LNG exports to keep growing fast as an outlet for their record gas output. But after soaring 68% in 2019 and 53% in 2018, U.S. LNG exports were only expected to rise about 7% in 2020.

With U.S. LNG capacity rising as new units enter service, utilization of those plants has collapsed from 85%-90% in 2019 to just 32% so far this month as buyers cancel dozens of cargoes.

Analysts at Simmons Energy, energy specialists at U.S. investment bank Piper Sandler, projected U.S. LNG utilization will hover between 60%-70% over the next several years.

Legendary investor Warren Buffett’s decision to walk away from a proposed export terminal for liquefied natural gas in Quebec is being held up in a new report as a sign that the LNG sector in Canada and elsewhere is on shaky ground.

The Global Energy Monitor report released Monday says Buffett’s move in March underscores the growing political and economic uncertainty that LNG projects are facing even as governments around the world tout liquefied natural gas as a clean alternative to coal power.

Monday’s report goes on to suggest that political opposition is only one of many new challenges to the LNG sector, with another being a dramatic drop in the price of gas due to an oversupply at a time when the COVID-19 pandemic has sent demand plummeting.

The result: plans to build pipelines, terminals and other infrastructure in Canada and around the world have been put on hold _ or dropped entirely.

The report lists 13 LNG projects in Canada alone that have been cancelled or suspended in recent years. That includes a $10-billion [Goldboro] LNG export facility in Nova Scotia, which is now in limbo as the company behind the project tries to decide whether to move ahead or not.

KBR to focus on government contracts, quit natural gas, energy business

Engineering and construction firm KBR Inc (KBR.N) will exit most of its liquefied natural gas (LNG) construction and other energy projects, it told investors and employees, as customers pull back on energy investments.

The company will refocus on government contracts and technology businesses, Chief Executive Stuart Bradie wrote to employees on Monday. It will “no longer engage in lump sum, blue collar construction services,” saying the COVID-19 pandemic accelerated the decision to leave fixed-contract energy projects.

KBR held contracts for engineering and construction services for several LNG projects, including at Freeport LNG in Texas, Pieridae Energy Ltd’s proposed Goldboro LNG facility in Nova Scotia, Canada, and Glenfarne Group’s Magnolia LNG project in Louisiana.

The task force’s climate change recommendations, out this week, push further than any policy proposed in previous general election platforms. They call for carbon-free power production by 2035, net-zero emissions for new buildings by 2030, and accelerated adoption of zero-emission vehicles. The authors frame the national climate response as a matter of equity for communities that have suffered disproportionately from pollution and climate impacts, and as a form of economic rebuilding after the coronavirus pandemic.

‘Million-mile’ batteries are coming. Are they a revolution?

Electric vehicles (EVs) have a clear environmental advantage over their gas-guzzling counterparts, but when it comes to longevity, the two are in a dead heat. Two hundred thousand miles is considered a good, long run for a car built today, regardless of whether it’s powered by a lithium battery or an internal combustion engine. But if a flurry of recent reports are to be believed, EVs may soon surge ahead in this long-distance competition — not by mere thousands of miles, but by 800,000.

But what does the million-mile battery revolution actually mean? According to experts in battery storage technology and the EV market, claims of new batteries that will last a million miles don’t tell us much on their own. How these batteries can be used is going to depend, first and foremost, on how they perform and degrade over their so-called “million-mile” lifespan. Several experts pointed out that true million-mile batteries are likely to outlast whatever cars they’re built for, meaning their arrival could dramatically impact both second-use markets and battery recycling.

2020 was supposed to be the year America revolted against plastic.

Consumers were refusing straws and toting their own coffee mugs. Legislators had proposed an unprecedented wave of laws to ban single-use plastics. Even companies like Coke and Pepsi were opening up to the idea plastic might not be the future.

Then came the Covid-19 pandemic. Now activists worry the anti-plastic movement is once again back in the trenches.

The fight has stalled on a number of fronts across the US. Fears about the virus spreading on surfaces prompted several states to temporarily ban reusable grocery bags, sending single-use bags flooding back into the marketplace. Major legislation aimed at reducing plastics packaging has stalled as lawmakers’ priorities shifted elsewhere. Disposable masks and gloves have become the harbingers of pandemic life, along with plastic take-out food containers and the debris of Amazon packages.

Meanwhile the plastics industry ramped up its lobbying, urging federal agencies to declare the sanitary benefits of disposable plastics, and arguing that plastic bag bans went against public health.

Welcome back.

There’s continued interest in the recent arrest of two environmental activists in Louisiana on felony terrorism charges for their non-violent action delivering a box of “nurdles” to a plastics industry lobbyist. It’s hard to know whether to laugh or cry.

We’re happy to report that the Holleran family has been compensated by the Williams Companies for hundreds of trees cut on their Pennsylvania farm to make way for a pipeline that was never built. The Constitution Pipeline was recently scrapped when New York refused to permit it. As a side note, we’re pretty sure Massachusetts Governor Charlie Baker could use a similar argument to stop the Weymouth compressor.

Future cases like the Holleran family’s tree loss may have been averted by a recent DC Circuit Court ruling that found the Federal Energy Regulatory Commission (FERC) can no longer continue its use of “tolling orders” to indefinitely delay hearing landowner complaints, even while trees are cleared and pipelines are built across their properties.

This week, Democrats in the House of Representatives passed a sweeping and serious new climate proposal, including measures for greening the economy in the post-pandemic recovery. The Trump administration and Senate Republicans declared the bill dead on arrival. You can express your opinion of that by voting on or before Tuesday, November 3, 2020…. Meanwhile, the need for transformative action is especially acute in coal country. A gradual contraction of that mining economy has recently morphed into freefall – with relief and a new economic model desperately needed.

Some of us have noticed recently that the latest generation of climate models occasionally predicts substantially more warming than prior models did. We found an interesting article exploring that anomaly, and revealing the devilish complexities around cloud effects. We also have a fascinating story of coal-driven climate change from 250 million years ago, plus encouraging news indicating that the Heartland Institute – a major force in climate denial – appears to be losing influence.

Electricity will not entirely replace fuels in the foreseeable future because some processes and modes of transport are just too energy intensive. Hydrogen is a strong alternative candidate, but it’s currently produced using fossil fuels. “Green” hydrogen is coming – our Clean Energy section offers a primer.

Energy efficiency upgrades, especially in commercial and industrial sectors, are among the most cost-effective ways to reduce emissions. That is not necessarily true for existing low-income housing, but taken as a component of redressing social injustice, it’s a compelling program that deserves high priority. Another priority is greening the transportation sector. It’s at once the largest greenhouse gas emitter and Big Oil’s best customer. We’re seeing both progress and push-back.

We wrap up with a few articles about the fossil fuel industry. It’s a gutter tour through financial collapse, attempted influence against green legislation, and a tightening circle of litigation calling out years of fraud.

Outrage after “Cancer Alley” activists face terrorism charges for anti-plastics stunt

For decades, those on the frontline of the environmental justice struggle have faced legal intimidation and harassment for speaking out against chronic pollution in “Cancer Alley,” an 85-mile stretch of oil, gas, and petrochemical facilities along the Mississippi River between Baton Rouge and New Orleans, Louisiana.

According to the Times-Picayune, “[Anne] Rolfes was booked with terrorizing, a felony punishable by up to 15 years in prison. [Kate] McIntosh was booked with principal to terrorizing.” Each was released after posting a USD 5,000 bond.

So what had they done to deserve a felony terrorism charge and potentially face years in prison?

Over six months ago, in December, they left a highly symbolic sealed box containing plastic pellet waste on the doorstep of a local oil and gas lobbyist to highlight the issue of chronic pollution in the region, which is home to some of the most impoverished and vulnerable communities in the United States.

In that sense [the charges] are SLAPPs — Strategic Lawsuits Against Public Participation. We know legal intimidation is getting worse in the US.

Indeed, as Earther points out: “In the past four years, 21 states have introduced criminal penalties for demonstrating near oil and gas infrastructure with many of those laws mirroring text drafted by the industry-backed American Legislative Exchange Council. In 2019, the federal government proposed legislation that would prescribe up to two decades in prison for ‘inhibiting the operation’ of pipelines — or even just ‘conspiring’ to do so. But even by those standards, these charges seem utterly gratuitous.”

A Northeastern Pennsylvania family who watched as work crews, accompanied by armed federal marshals, destroyed their budding maple tree farm to make way for the failed Constitution Pipeline has settled with the company Williams for an undisclosed amount. A federal court has also vacated the eminent domain taking of about five acres, reversing an order it made more than five years ago.

“We’re really glad that it’s ended,” said Catherine Holleran, co-owner of the 23-acre property that has been in the family for 50 years. “We’ve gotten our land returned to us. That was our main objective right from the first.”

The Constitution Pipeline project would have carried Marcellus Shale gas  from Pennsylvania to New York state. Though the project received federal approval and the necessary permits from Pennsylvania regulators, New York blocked the pipeline by not issuing permits. Williams dropped the project in February.

DC Circuit: FERC can’t indefinitely delay action on gas pipeline challenges

The District of Columbia Circuit Court of Appeals ruled 10-1 on Tuesday that the Federal Energy Regulatory Commission lacks authority to postpone rehearing decisions on natural gas projects through the issuance of tolling orders. The practice has delayed parties that oppose FERC rulings from challenging those decisions in court.

FERC Commissioner Richard Glick called the decision a “resounding victory” for landowners impacted by FERC’s pipeline orders. “It is important that these parties can go to court before a company can take their land & build a pipeline affecting their communities,” he said in a tweet.

Tolling orders are an accessible tool for FERC to delay judgement on rehearing requests when more time is needed to consider arguments regarding the legality of the commission’s actions. FERC attorney Robert Kennedy said tolling orders are “generally entered almost as a matter of routine.”

Petitioners argued that pipeline projects have been completed while opponents were unable to litigate because a tolling order was in place.

“This case is exceptionally important because it brings to light a habitual practice by [FERC] that raises serious questions of fairness, due process and legality. And the commission’s defense in no way addressed how [a FERC order] can be final for some but not for others,” NRDC’s Giannetti told Utility Dive.

Lawyers representing the New England Ratepayers Association (NERA) on Tuesday filed their response to the almost 50,000 comments opposing the group’s petition to federal regulators to effectively upend net metering policies nationwide.

NERA has generated significant attention in the power sector with its April petition asking FERC to declare “exclusive” jurisdiction over behind-the-meter energy generation.

Bipartisan groups of state legislators, regulators, attorneys general, governors and other officials filed almost 100 comments in opposition. Advocacy groups, legal experts and academics filed over 500 comments, while almost 50,000 individuals also commented on the filing, all in opposition to the proposal.

Meanwhile, just 21 groups filed in support, 15 of which echoed comments written out by the Heartland Institute.

Net metering compensates customers who have rooftop solar or some other form of behind-the-meter resource for the energy it provides to the grid. Opponents of the practice say it can overcompensate distributed resource customers, leaving remaining customers to absorb the additional costs. The focus of the petition, however, is not on the merits of net metering, but whether FERC should have jurisdiction over those sales.

Democrats to unveil bold new climate plan to phase out emissions by 2050

House Democrats will unveil an aggressive climate crisis “action plan” on Tuesday to nearly eliminate US emissions by 2050, according to summary documents reviewed by the Guardian.

The net-zero emissions goal is what United Nations leaders and the scientific community say the world must achieve to avoid the worst of rising temperatures, and it’s what the Democratic presidential nominee, Joe Biden, says he would pursue if he were to win the White House in November.

The more than 538-page report will include hundreds of policy recommendations focused on 12 key pillars, according to a separate outline.

Modeling on a subset of those recommendations by the firm Energy Innovation showed they would cut net US greenhouse gas emissions by 37% below 2010 levels in 2030, and 88% below 2010 levels in 2050, according to the report outline. The remaining 12% of emissions cuts would have to come from hard-to-decarbonize sectors, including heavy-duty truck transportation, industry and agriculture.

The proposal outline recommends a clean energy standard for net-zero electricity by 2040 and net-zero new buildings by 2030. It calls for only zero-emitting new vehicles to be sold by 2035, and it advocates for doubling funding for public transit.

The global coronavirus that’s put tens of millions of Americans out of work and plunged the nation into a recession is speeding an ongoing transition away from coal.

With devastation in communities left behind, 80 local, regional and national organizations on Monday rolled out a National Economic Transition Platform to support struggling coal mining cities and towns, some facing severe poverty, in Appalachia, the Illinois Basin, Montana, Wyoming, Arizona and elsewhere.

Although it comes just four months before the presidential election in November, the platform doesn’t mention the Green New Deal, the proposed massive shift in federal spending to create jobs and hasten a transition to clean energy that’s divided Republicans and Democrats.

But Heidi Binko, executive director of the Just Transition Fund, which drafted by the plan with a wide range of partners, including labor unions, community organizations, business groups and environmental and tribal nonprofits, said it could be used as a template for part of the Green New Deal or any other legislative initiatives aimed at helping coal communities.

Hard Times in the Climate Denial Business for the Heartland Institute

Last week, the Heartland Institute was again trumpeting climate science denial at its 13th “International Conference on Climate Change” at the Trump Hotel in Washington, D.C. But by a number of measures, the Chicago-based free market think tank’s science denial doesn’t exactly seem to be a growing — or cohesive — movement at this point.

That’s even with more media coverage than five years ago, and with friends in high places. In early 2017, following the election of President Trump, attendees of the Heartland Institute conference were clearly excited to have a climate denier in the White House. Frontline reported that the mood at the conference was “jubilant.”

Even last year, the organization was projecting an air of optimism. Former Congressman Tim Huelskamp was still Heartland president and confidently declaring victory for the climate denial movement.

“It took a while, but we think we’ve won the battle — Al Gore was wrong,” Huelskamp said.

So, how are things going for Heartland these days?

Connecticut’s average temperature has risen 2 degrees Celsius since the late 19th century, double the average for the Lower 48 states.

Connecticut is one of the fastest-warming states, in the fastest warming region, in the contiguous United States. An analysis last year by The Washington Post found that neighboring Rhode Island was the first state among the lower 48 whose average annual temperature had warmed more than 2 degrees Celsius since 1895. New Jersey was second, the Post found, followed by Connecticut, Maine and Massachusetts.

The Post analysis also found that the New York City area, including Long Island and suburban counties in New Jersey, New York and Connecticut, was among about half a dozen hot spots nationally where warming has already exceeded 2 degrees. The others are the greater Los Angeles area, the high desert in Oregon, the Western Rocky Mountains, an area from Montana to Minnesota along the Canadian border and the Northeast Shore of Lake Michigan.

Climate scientists don’t fully understand why Connecticut and the other Northeast states have warmed so dramatically, but they offer an array of explanations, from warm winters that produce less snow and ice (and thus reflect less heat back into space) to warming ocean temperatures and  changes in both the jet stream and the Gulf Stream.

So, What Exactly Is Green Hydrogen?
For a colorless gas, hydrogen gets described in very colorful terms. A new GTM series helps explain the weird and wonderful world of clean energy.

According to the nomenclature used by market research firm Wood Mackenzie, most of the gas that is already widely used as an industrial chemical is either brown, if it’s made through the gasification of coal or lignite; or gray, if it is made through steam methane reformation, which typically uses natural gas as the feedstock. Neither of these processes is exactly carbon-friendly.

A purportedly cleaner option is known as blue hydrogen, where the gas is produced by steam methane reformation but the emissions are curtailed using carbon capture and storage. This process could roughly halve the amount of carbon produced, but it’s still far from emissions-free.

Green hydrogen, in contrast, could almost eliminate emissions by using renewable energy — increasingly abundant and often generated at less-than-ideal times — to power the electrolysis of water.

A more recent addition to the hydrogen-production palette is turquoise. This is produced by breaking methane down into hydrogen and solid carbon using a process called pyrolysis. Turquoise hydrogen might seem relatively low in terms of emissions because the carbon can either be buried or used for industrial processes such as steelmaking or battery manufacturing, so it doesn’t escape into the atmosphere.

However, recent research shows turquoise hydrogen is actually likely to be no more carbon-free than the blue variety, owing to emissions from the natural-gas supplies and process heat required.

‘Simple’ or a ‘band-aid’? ISO-NE leans toward Eversource/National Grid $49M solution for Mystic plant replacement
New England’s grid operator chose the lowest-cost proposal, but one developer says that doesn’t make it the most effective or efficient.

ISO New England in June identified National Grid and Eversource’s “Ready Path Solution” as the most cost-effective way to address transmission reliability issues following the planned retirement of the Mystic Generating Station in 2024.

The $49 million project is inexpensive and relatively simple compared to 35 other proposals, which carried price tags up to $745 million.

The ISO is expected to issue a final decision July 17 and is accepting comments through today. At least one competing developer is unhappy with the grid operator’s initial determination: Officials at Anbaric Development Partners say the Ready Path approach is a “band-aid” that will not address the region’s longer-term energy needs.

According to Anbaric, its project would eliminate the need for $620 million in near-term system upgrades the ISO will need to address to incorporate offshore wind being procured by the region.

The time is right to bolster such programs since the pandemic’s economic effects mean more households will likely need assistance with energy bills, advocates say.

Studies — including a recent one by Lawrence Berkeley Livermore National Laboratory — show that dollar for dollar, the biggest efficiency gains can be made by investing in commercial and industrial energy conservation, while efficiency programs targeting low-income customers are among the least cost-effective.

However, many consumer groups, utilities, researchers and other stakeholders agree: The benefits provided by helping low-income customers are wide-ranging, and especially important to advance racial equity and protect vulnerable people in times like these.

Europe’s Demand for Electric Cars May Get a Jolt From COVID-19 Response

Stimulus packages, falling costs and rising environmental awareness may rev Europe’s EV market quicker than expected, analysts say.

Far from depressing the market, the response to the COVID-19 outbreak looks set to accelerate the uptake of electric vehicles across Europe.

The combined market share of EVs and plug-in hybrids jumped 6.8 percent in the first quarter of the year, faster than the 2.5 percent growth seen in the same quarter last year, according to sales figures from the European Automobile Manufacturers’ Association (ACEA).

And that was before big pandemic-recovery stimulus plans began targeting the EV market. In contrast, total sales of new passenger plunged 41.5 percent between mid-March and the end of May, according to the ACEA.

But in the U.K., where monthly data is available from the Society of Motor Manufacturers and Traders, battery electric vehicles are performing well. In May, new petrol and diesel registrations were down around 90 percent compared to the same time last year. BEVs were up 21.5 percent. A tax break for corporate buyers that started in April won’t have hurt.

“In the very short term, we have seen that EV uptake rates have been immune to the drop-off in new car sales,” John Murray, head of EV research at the consultancy Delta-EE, said in an interview.

Oil Industry and Allies Look to Pump Brakes on Democrats’ Plans to Move Transportation Off Petroleum

This week Congressional Democrats in the U.S. House of Representatives put forward policies, including passing a $1.5 trillion infrastructure bill on July 1, aimed at cleaning up the number one source of carbon pollution in America — the transportation sector. The oil and gas industry and its supporters quickly weighed in, framing “the critical role” of the industry in addressing climate pollution and in some cases outright attacking these plans’ efforts to move away from petroleum-powered transport.

It is the first time a body in Congress has set a deadline for selling 100 percent zero-emission vehicles, which include electric or fuel cell cars. Over a dozen countries have already set timetables for phasing out conventional petroleum-powered vehicles.

The chances that the infrastructure package and many other policies outlined in the Democrats’ climate plan will become law under the Republican-controlled Senate and President Donald Trump are very slim to none. According to The Hill, Trump slammed the infrastructure package as “full of wasteful ‘Green New Deal’ initiatives” and Senate Majority Leader Mitch McConnell (R-KY) called it “nonsense.” Both Trump and McConnell receive sizable campaign contributions from the fossil fuel industry, according to OpenSecrets.org.

Oil industry trade associations and front groups funded by the oil and gas industry are already coming out against the Democrats’ climate plan and infrastructure package.

As electric planes pass another milestone, Future Planet asks how long will it be before they are ready for everyday aviation? And just how far can they go?

At a large airfield surrounded by farmland in central Washington State, an electric aeroplane recently made history. It is the biggest commercial plane ever to take off and fly powered by electricity alone. For 30 minutes on 28 May, it soared above Grant County International Airport as crowds of onlookers clapped and cheered.

The biggest electric plane ever, huh? Well, it was a modified Cessna Caravan 208B – which can take a maximum of nine passengers. And the test aircraft only had a seat installed for the pilot.

It’s a far cry from the 200-300-seater jet that takes you on weekend city breaks or work trips, never mind the huge double-decker planes that cross continents. But the “eCaravan” test flight was a success. The two companies behind it, AeroTEC and magniX, which supplied the electric motor, are chuffed with the results. Roei Ganzarski, chief executive of magniX, pointed out in a statement that the price of flying the Cessna clocked in at a mere $6 (£4.80). Had they used conventional engine fuel, the 30-minute flight would have cost $300-400 (£240-320).

For years, Big Oil denied there was a problem with climate change and carried on drilling, deliberately creating doubt over the science. They could have acted decades ago, but they did not.

As our climate crisis intensified, the industry shifted its public relations strategy and started touting natural gas as a so-called “clean” bridge fuel, a stepping stone if you like, from dirty oil to renewables. There were major flaws in that argument, that gas is neither green nor clean, as OCI and others have repeatedly pointed out.

The other blatantly obvious flaw that climate activists pointed out was that the climate emergency was so urgent that we did not have time to carry on the fossil fuel age in any shape or form, whether oil or gas, and we should be investing in renewables now.

Two weeks ago, there was what I termed an “historic moment” when BP slashed up to USD 17.5 billion off the value of its assets after lowering its longer term price assumptions in the wake of COVID-19. In the words of the Financial Times, BP “expects” the pandemic “to hasten the shift away from fossil fuels.” BP’s assets were essentially stranded.

Whereas BP’s write-offs were largely in dirty heavy oil and offshore, what will be sending shocks waves through the industry is that Shell’s write-downs are in gas.

Two of the world’s largest energy companies have sent their strongest signals yet that the coronavirus pandemic may accelerate a global transition away from oil, and that billions of dollars invested in fossil fuel assets could go to waste.

This week, Royal Dutch Shell said it would slash the value of its oil and gas assets by up to $22  billion amid a crash in oil prices. The announcement came two weeks after a similar declaration by BP, saying it would reduce the value of its assets by up to $17.5 billion. Both companies said the accounting moves were a response not only to the coronavirus-driven recession, but also to global efforts to tackle climate change.

Some analysts say the global oil and gas industry is undergoing a fundamental transformation and is finally being forced to reckon with a future of dwindling demand for its products.

On Thursday, June 25, an organization named the Mass Coalition for Sustainable Energy criticized Massachusetts State Senate climate legislation now pending before the House of Representatives. In response, State Senators Mike Barrett and Jason Lewis issued the following statement.

In January of this year, the Massachusetts State Senate passed An Act Setting Next-Generation Climate Policy, now pending before the House of Representatives. The Senate’s approach to reducing greenhouse gas emissions is radical not in its ideology but in its seriousness; we’re determined to get emissions down across the Massachusetts economy, transportation and buildings included.

We should add that the senators who wrote the legislation sat down with a good many commercial interests, listened to what they had to say, and made changes. At the time of the bill’s final passage — with the votes of both Democrats and Republicans, and with only two dissents in the 40-member Senate — its seriousness of purpose seemed to impress the business community without unsettling it.

But that was then. With the onset of COVID-19, conservative elements are eager to exploit an opening. Two years ago, an investigative report in the Huffington Post blasted the then-new Mass Coalition for Sustainable Energy as a “front for gas interests,” identifying, as major funders of the group, Eversource, National Grid, and Enbridge, the pipeline conglomerate behind the natural gas compressor station project in Weymouth.

Last week the Coalition surfaced anew, patching together a limp critique of Next-Gen that seems less about the bill and more about the Coalition’s longer-range objective, which is to keep fossil fuels at the heart of Massachusetts energy policy.

Oil and gas coloring books teach kids safety, fossil fuel dependence

It’s finally summer: The time of year when your kids run through the sprinklers, munch on watermelon, and whip out their crayons to scribble in coloring book pages of fracking wells and gas pipes. Wait, what?

Last week, Puget Sound Energy, the Seattle-area utility, shared an odd activity on Twitter: “Color your way through Natural Gas Town and learn how natural gas provides energy to your neighborhood!” The tweet, later deleted, linked to an online coloring page showing a detailed map of how natural gas lines run underneath your yard and into your home. The image is from Energy Safe Kids, a national program that teaches children safety tips — like how to sniff out a gas leak and avoid pummeling natural gas meters with water balloons.

The Energy Safe Kids site includes an interactive coloring page for the friendly gas flame named “Don Fuego,” a video game called “Gas Dash” in which your character hurdles gas meters and fire extinguishers while riding a bike, and a word search that challenges you to find “butane,” “pilot light,” and “cogeneration.”

Fracking pioneer Chesapeake files for bankruptcy protection

Chesapeake Energy, a shale drilling pioneer that helped to turn the United States into a global energy powerhouse, has filed for bankruptcy protection.

The Oklahoma City-based company said Sunday that it was a necessary decision given its debt. Its debt load is currently nearing $9 billion. It has entered a plan with lenders to cut $7 billion of its debt and said it will continue to operate as usual during the bankruptcy process.

The oil and gas company was a leader in the fracking boom, using unconventional techniques to extract oil and gas from the ground, a method that has come under scrutiny because of its environmental impact.

Other wildcatters followed in Chesapeake’s path, racking up huge debts to find oil and gas in fields spanning New Mexico, Texas, the Dakotas and Pennsylvania. A reckoning is now coming due with those massive debts needing to be serviced by Chesapeake and those that followed its path.

Both Minnesota and D.C. sue Big Oil for “campaign of deception” over climate change

Big Oil’s decades-old campaign to deny, deceive, and delay action on climate change has been thrust into the spotlight again after both Attorney Generals for Minnesota and the District of Columbia (D.C.) launched legal action against the industry within twenty-four hours of each other.

First yesterday, Minnesota Attorney General Keith Ellison filed the suit against Exxon, the American Petroleum Institute (API), and three Koch Industries for pushing climate denial for decades.

The 84 page document did not mince its words, arguing, “that the economic devastation and public-health impacts from climate change” in Minnesota “were caused, in large part, by a campaign of deception that Defendants orchestrated and executed with disturbing success.”

Dating back decades, instead of warning Minnesota about the risks of climate change, the “Defendants realized massive profits through largely unabated and expanded extraction, production, promotion, marketing, and sale of their fossil-fuel products.”

The suit cited scientific evidence dating back to the fifties and sixties. “By 1965, Defendants and their predecessors-in-interest were aware that the scientific community had found that fossil-fuel products, if used profligately, would cause global warming by the end of the century, and that such global warming would have wide-ranging and costly consequences,” the suit said.

Instead of acting responsibly, the companies repeated the playbook of the tobacco industry and funded “fraudulent scientific research” in order to create uncertainty.

And instead of acting in the public interest, and investing in alternatives to fossil fuels, the Defendants just carried on drilling for oil and gas, making extreme profits.
